Brewster Town Office Building Chairman Henchy convened the Planning Board work session at 5:00 pm in the Brewster Town Office Building with members Henchy, Taylor, Pierce, Tubman, McMullen and Barnard Present: Ed Lewis, Jillian Douglass, Joanne Hughes, Victor Staley, Bob Porter and Consultant, Jon Witten AGENDA 5:00 pm WORK SESSION #8 - To review and discuss the following: 1. Water Quality Protection Bylaw 2. Earthmoving, Earth Removal and Excavation 3. Land Clearing and Grading 7:00 pm To review and discuss modifying the following proposed by-laws: 1. Home Occupations 2. Cluster Residential Development 1. Water Quality Protection Bylaw - The status of the special legislation that would make the WQRC the SPGA was discussed. It was determined that the Legislation would not be done prior to town meeting. It was therefore agreed to move forward with the bylaw based on the Planning Board being the SPGA which would receive the input from the Water Quality Review Committee on each application. It was pointed out that an extension may be required for the application because the WQRC doesn't meet as frequently and it might be necessary in order to be in accordance with State regulations. A review of the draft bylaw occurred. It was noted that the bylaw needed to be reviewed by DEP -Jillian had forwarded yesterday. Ed Lewis requested that the bylaw be reviewed by all committees and departments and that they provide their input/support prior to Labor Day. A Public Hearing Date of August 27 was scheduled. 2. Sand & Gravel bylaw - A review of the existing bylaw occurred. A discussion revolved around the need to set limits and guidelines for certain businesses. John McMullen expressed reservation about adding another layer of regulations for these businesses and wondered if there was another way to Planning Board Meeting Page 1 of 2 07-31-08 handle. He further pointed out that the issue seemed to be more a lack enforcement. It was pointed out that some of the restrictions had been modified based on input received. Jon Witten pointed out that this bylaw would: 1. Remove the allowance of mining by right and would require a special permit all over town. 2. Additional requirements would be required for each applicant 3. Existing businesses would not need a special permit unless they wanted to expand, alter or change their use. If they wanted to do any of these things then they would be required to go to the Planning Board for a Special Permit. Pierce pointed out that the DEP allowed mining up to 4 feet above ground water. Jon Witten noted that was a guideline and that for the Cape that is not a good measurement because the land here is sand and accidents would get to the groundwater here much faster. It was agreed that the sand & gravel operators should be invited in for a work session on August 13 and the Board could hear their input. Further Ed Lewis requested that this bylaw also be circulated amongst the committees and departments in an effort to obtain their feedback. 3. Land Clearing bylaw: There was a lengthy discussion regarding the proposed bylaw. Some of the board questioned the impact of adding another restriction to property owners and thought that people should be allowed to do what they want with their land. Some of the Board members expressed concern about clear cutting and the implications of that on the environment. It was agreed to table this bylaw until the spring. 4. Home Occupations bylaw: There was a brief discussion regarding the bylaw and a few minor changes were noted. A Public Hearing was scheduled for August 27t" 5. Cluster Residential bylaw: A brief discussion occurred and it was agreed to hold the Public Hearing for this bylaw on the 27t" as well. McMullent motioned to adjourn. Tubman seconded.
