ARESOLUTION: AUTHORIZING AN AGREEMENT AND APPROVING A
PERFORMANCE GUARANTEE FOR ROUTE 7 AT RIVER CREEK
P ARKWAY INTERCHANGE INTERIM GRADING AND UTILITY
PLAN
WHEREAS, Springfield East L.C., the developer of the Route 7 at River Creek Parkway
Interchange Interim Grading and Utility Plan, has requested approval of a corporate surety bond
from the Berkley Regional Insurance Company in the amount of $3,169,000 to guarantee the
public improvements; and
WHEREAS, the Director of Engineering and Public W orks recommends approval of a
contract for installation of public improvements and acceptance of a performance guarantee for
the Route 7 at River Creek Parkway Interchange Interim Grading and Utility Plan.
THEREFORE, RESOL VED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The Town Manager shall execute the contract for public improvements for
the improvements shown on the plans approved by the Director of Engineering and Public Works
for the Route 7 at River Creek Parkway Interchange Interim Grading and Utility Plan.
SECTION II. The corporate surety bond in a form approved by the Town Attomey from
the Berkley Regional Insurance Company in the amount of $3,169,000 is approved as security to
guarantee installation of the public improvements shown on plans approved by the Director of
Engineering and Public W orks for the Route 7 at River Creek Parkway Interchange Interim
Grading and Utility Plan.
