A RESOLUTION: AUTHORIZING A TIME EXTENSION FOR COMPLETION OF THE
PUBLIC IMPROVEMENTS AND APPROVING A PERFORMANCE
GUARANTEE FOR POTOMAC STATION PHASE 3, SECTION 10;
AND SECTION 10 PUBLIC IMPROVEMENTS
WHEREAS, Goose Creek Communities, L.L.C., the developer of Potomac Station Phase
3, Section 10; and Section 10 Public Improvements has not completed all the required public
improvements in accordance with the approved construction drawings and Town standards
within the two-year period agreed to in the contract for public improvements; and
WHEREAS, the developer has requested a time extension to complete the public
improvements; and
WHEREAS, corporate surety bonds from the Gulf Insurance Company in the amount of
$1,710,000 for Phase 3, Section 10; and in the amount of $1,260,000 was provided by the
developer to guarantee the installation of public improvements; and
WHEREAS, the Town's Director of Engineering and Public Works recommends a time
extension to August 13,2008 for Phase 3, Section 10; and to July 9,2008 for Section 10 Public
Improvements.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION I. The corporate surety bonds from the Gulf Insurance Company are
approved to guarantee the installation of public improvements in Potomac Station Phase 3,
Section 10; and Section 10 Public Improvements.
