Brewster Town Office Building Chairman Henchy convened the Planning Board meeting at 7:00 pm in the Brewster Town Office Building with members Taylor, Tubman, Pierce, Bugle and Barnard. Chairman Henchy opened the hearing October 8, 2008 by reading the legal advertisements and making the applicant and parties in interest aware of their rights to appeal as required under Chapter 40A, Section 17. He stated that during the hearing any member of the Board or interested party could direct questions through the Chairman to a speaker relating to the proposal. Other Business: A. Review of Preliminary Comprehensive Permit Fee and Consulting Expenses for ZBA -ZBA to attend the meeting to discuss Present: Phil Jackson, Bob McClellan, Pat Edgers, Art Stewart, Bruce McGregor Jackson: Discussed the recommendations to the ZBA prepared by D. Heaton. Of particular interest was the comprehensive fee that the town charges for definitive subdivision and other permits. Currently the rate is low and should be reviewed. The fees of the ZBA should be in line with the Planning Board fees. It can cost the ZBA/Town anywhere from $2,000-10,000 for a professional review. Barnard: Agreed that the Town should recover all the costs associated with reviews and that any consultant fees should be added on top of the application fee. A review of fees charged by other towns was undertaken along with a lengthy discussion regarding adjusting the fees. The final consensus was as follows: - ANR application fee = $300 + $100/lot - Preliminary definitive subdivision fee = $1,500 + $100/lot - Definitive subdivision fee = $5,000 + $200/lot - Major definitive modification = $3,000 + $100/unit - Road Name = $300 - Road Inspection = .75/foot -Site Review = $500 - Lot release - no charge In order for the fees to be increased the Board must hold a public hearing. Bugle: Motioned to reset the fees and to hold a Public Hearing. Seconded by Barnard. All Aye. Planning Board Meeting Page 1 of 3 10-08-08 CONTINUED LEGAL HEARING #2008-07 for Modification of COPD. Applicant: Bud Noyes/Owner: N&N Real Properties, LLCC -Located at 2689 Main Street, Assessors' Map 14; Parcel 50. Proposal to recognize the rear gravel parking lot as a designated parking area. In addition, to increase seating capacity to 120 seats. Present: Bud Noyes Noyes: Brought the Board back up to speed on his application. Really just wants to be able to change his certificate to accommodate the increased seating. At the previous meeting the police dept. had a concern with the parking on Winslow Landing. Mr. Noyes has modified the parking plan and removed 2 spaces on that Road. Taylor: would like to see bumpers added to the stone area Noyes: agreed Bugle: didn't see any problems with the application Henchy: Questioned whether M. Noyes needed to submit engineered plans. It was agreed that a plan was required only if Victor Staley, the Building Commissioner and would require. Bugle: Motioned to draft a favorable decision. Seconded by Taylor. All Aye. CONTINUED LEGAL HEARING -COPD#2008-16. Applicant: Clyde Mosher, Owner: Town of Brewster, Located at 3171 Main Street, Assessors' Map 8; Parcel 9. Proposal to repair and restore the two larger outbuildings. The Brewster Historical Society currently operates and maintains its Museum on Route 6A. - Review Draft Decision Present: Clyde Mosher A review of the decision occurred and a few minor modifications were noted. Below is the vote of the individual members of the Planning Board on Application #COPD2008-16, Town of Brewster, The Brewster Historical Society, Special Permit APPROVED as voted on October 8, 2008 Present and voting: William Henchy AYE Amberlyn Tubman AYE Elizabeth G. Taylor AYE Robert Bugle AYE Robert Barnard AYE CONTINUED LEGAL HEARING COPD #2008-08 -Applicant: Gloriae Dei Artes Foundation, Inc. Owner: HKN Trust -Property Located at 36 Southern Eagle Cartway, Assessors' Map 30; Parcel 18-1-R. Proposal to use an existing 78' x 50' building on a mixed-use site by anon-profit educational corporation for storage of educational equipment and materials.- Review Draft Decision A review of the decision occurred and a few minor modifications were made. Below is the vote of the individual members of the Planning Board on Application #COPD2008-20, Gloriae Dei Artes Foundation, Inc., Special Permit APPROVED as voted on October 8. 2008 Present and voting: William Henchy AYE Elizabeth G. Taylor AYE Robert Barnard AYE Planning Board Meeting 10-08-08 Amberlyn Tubman AYE Robert Bugle AYE Page 2 of 3 Informal Discussion: Robert Doeg, Assessors' Map 21; Parcel 82-1. To discuss the Agreement and Covenant for the Harrison Hill Subdivision. It was noted that Mr. Doeg was not present again. Ms. Taylor motioned to put a lock on all permits for the Harrison Hill Subdivision until Mr. Doeg comes before the Planning Board. Seconded by Bugle. All Aye. ANR#2008-26 -Applicant: Elizabeth Taylor -Property Located at 329 Run Hill Road, Assessors' Map 35; Parcel 64-1. Proposal to add 4, 701 SF by moving her current property line to the property at 245 Run Hill Road. Planning Board members sitting on the hearing were: Henchy, Barnard, Bugle and Tubman. Ms. Taylor recused herself to present her case. Present: Elizabeth Taylor Taylor: Reviewed her application/plan and the reason for her request. A brief discussion occurred. Bugle: motioned to endorse the plan. Seconded by Tubman. All Aye. OTHER BUSINESS: B. ZBA Requests: 1. White Rock Commons Comprehensive Permit - 3~d and "final" revision proposed by the applicant. ZBA would like final comments from the Planning Board. A brief discussion occurred and it was agreed that Mr. Henchy would draft a letter for ZBA. 2. White Rock Commons Comprehensive Permit -Paved or gravel surfaces for driveways? A brief discussion occurred and it was agreed that a paved surface was preferred. Notification would be given to ZBA 3. Department Review - - ZBA requested a review of their pending applications. The Planning Board noted that on the pending Wind Turbine application the turbine needed to have safe fall zone. C. Review Town Counsels opinions regarding proposed zoning bylaws A brief discussion occurred and Ms. Taylor noted specific changes that needed to be made. McMullen: Motioned to adjourn.
