WHEREAS, the Commonwealth of Virginia created the Transportation Partnership
Opportunity Fund (TPOF) to be used by the Governor to encourage the development of transportation
projects through design-build processes; and
WHEREAS, the Virginia Department of Transportation (VDOT) is administering the
development the segment of Battlefield Parkway from Kincaid Boulevard to Route 7 (East Market
Street) under a design-build contract; and
WHEREAS, Resolution No. 2007-21 authorized the Town Manager to apply for grant funds
from the VDOT Transportation Partnership Opportunity Fund (TPOF); and
WHEREAS, on February 12,2007, Governor Timothy M. Kaine approved the award ofa $5
million TPOF grant to the Town of Leesburg for the development of this segment of Battlefield
Parkway; and
WHEREAS, an administrative agreement is required to enable VDOT to utilize these TPOF
grant funds on the project;
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute the attached Transportation Partnership Opportunities Fund
Grant Agreement for the Battlefield Parkway (Kincaid Boulevard to Route 7) project in a form
acceptable to the Town Attorney.
