A RESOLUTION: APPROVING CHANGE ORDER NO. 12 FOR THE IDA LEE INDOOR
TENNIS FACILITY AND AUTHORIZING THE TOWN MANAGER TO
EXECUTE IT
WHEREAS, the Ida Lee Indoor Tennis Facility is a funded capital project; and
WHEREAS, the original lowest responsible and responsive bidder was received from
Tessa Construction & Tech Companyin the amount of $2,472,692; and
WHEREAS, staff negotiated a contract amount of$I,791,340 with Tessa to exclude the
Pavilion and site lighting; and
WHEREAS, Resolution No. 2007-74 awarded the construction contract to Tessa

Construction & Tech Company, LLC in the amount of$I,791,340; and
WHEREAS, the Department of Capital Projects Management was able to negotiate with
the contractor to add both of these items back into the contract at a cost savings of$325,484; and
WHEREAS, Change Orders No. 1 through 11 are within the 25% of original contract price
and have been administratively approved; and
WHEREAS, Change Order No. 12 caused the cumulative sum of change orders to exceed
the higher of $50,000 or 25% administrative approval level and thus requires Town Council
approval; and
WHEREAS, Change Order No. 12 is related to a design change in the area where the air
structure connects to the masonry entry structure and is considered a betterment to the project by
increasing the longevity and durability of both the air structure and entry building; and

WHEREAS, the Department of Capital Projects Management recommends the approval of
this change order; and
WHEREAS, a total of $2.5 million was earmarked for this project; and
WHEREAS, the total project cost to date is approximately $2,591,975.38; and
WHEREAS, additional funds are available in the capital projects fund under a
reimbursement resolution for this project; and
WHEREAS, the capital projects fund will be reimbursed when the interim financing is
complete by December 2007.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that
Change Order 12 in the amount of $24,854.50 is hereby approved, and the Town Manager is
