ITEM #6: The major subdivision Woodstone was reviewed as a preliminary plan, courtesy review from Orange County. Woodstone Subdivision (4.38A.. 5, 12) is a development of 58 lots with a new road called Woodstone Drive. Rigsbee stated that Woodstone Drive's status has not been ascertained as the NCDOT gave preliminary plan approval based on the road being non -state maintained. She felt there were slope and radius problems. Brunsen stated that the developer will work with the NCDOT to build a road that will meet state standards and they plan to dedicate the road to the state. The improving of Virginia Cates Road was discussed. Brunsen stated that they would provide a 3 lane intersection at Virginia Cates Rd., clear the brush for better sight distance and work with the NCDOT on creating a better angle at the intersection of Virginia Cates Rd. and Orange Grove Rd. Orange Grove Rd. safety factors were discussed and the Board agreed to ask the NCDOT to reduce the speed on Orange Grove Rd. to 45 mph or less and to erect crossroads signsindicating Virginia Cates Rd. The Board agreed to ask Dwight Kelly from NCDOT to review Orange Grove Rd. and provide an analysis of the need for left turn and deceleration lanes on Orange Grove Rd. The Board realized there may be a problem with a left turn lane as there are pillars of the I-85 overpass 15 feet from the edge of the pavement. Brunsen said he felt a requirement to add a turn lane and deceleration lane was a financial burden for the developers. Water and sewer for the project ate currently being reviewed by the Town Engineer and will proceed along normal channels for needed approvals. Brody asked about the problems of getting water to the 760' elevation. Brunsen replied that the Town Engineers are working on the problem and the development will have fire hydrants. Minutes, July 2, 1987 Page 2 The natural features and flora of Occonneechee Mountain were addressed. Rigsbee said that she received a letter from Laura Mansferd of the N.C. Natural Heritage Program and the letter stated that Occonneechee Mountain is of regional significance: Also, there are 3 species of plants on the mountain that are designated significantly rare. The question of protecting natural rock outcroppings was addressed. Brunsen stated that natural areas would be protected by an architectural review board. Page asked would protective measures be taken during road construction. Brody pointed out that erosion will be a serious problem during road construction. Brunsen said they will work with the Soil and Erosion Control Office. Thomas said they will save rare species. Brunsen said that lots 17 & 18 are restricted lots and rare plants could be planted in this area. Brunsen said that the lots will not be rearranged and all lots except lots 17 & 18 have buildable areas. The building of houses at the very top of the mountain was discussed and the Board was concerned that the houses will be visible from surrounding areas and desires that there be thought put to sight preservation. The following are the recommendations of the Board: 1) Woodstone Drive be constructed to state standards and accepted by the State for maintainance 2) Virginia Cates Road be paved with a 3 lane intersection on Virginia Cates Road according to NCDOT standards. 3) Rock outcroppings be designated on the final plat and protected 4) Rare flora habitats be designated on the final plat and a plan stated to protect the flora that shows extreme care is being taken toward this protection 5) Ask Dwight Kelly from the NCDOT to review the safety on Orange Grove Road with the possiblity of installation of left turn and deceleration lanes. 6) Ask Dwight Kelly and the NCDOT to reduce the speed on Orange Grove Rd. to 45 miles per hour or less and install crossroad signs indicating Virginia Cates Rd. 7) Request Orange County to forward the final plat to the Board for a final review Ashley moved that the above recommendation be forwarded to Orange County. Brody seconded. Unanimous. ITEM #4: The following are all items for the August 10, 1987, Public Hearing: ITEM #4al: Oakdale Woods Rezoning Request (4.44.A.9) to rezone 11.37 acres from R-15 with a Conditional Use Permit to MF. The Board concurred that: 1) require a left turn and deceleration lane on Oakdale Dr. to be constructed before construction takes place 2) inform the developers of future plans to make Oakdale Dr. a 5 lane road, 3) to inform the developer that the ordinance requires active recreation space and utilization of the pond for recreation will not qualify as active recreation. 11 r Minutes, July 2, 1987 Page 3 ITEM #4a2: 128 W. Margaret Lane Rezoning Request (4.36.A.11) to rezone 9,000 square foot lot from R-20/HD to OI/HD. The Board felt the Historic District Commission should be notified of this item. The general feelings of the Board was negative to this rezoning. ITEM #4a3: Wright Rezoning Request (4.14.A.4, 4A, 5, 6, 6A) to rezone approximately 70,250 square feet from R-10 to GC. The Board stated that in the past neighbors were opposed to this rezoning. Rigsbee stated that there is a new petition in favor of this rezoning. The Board agreed that this would increase the dangerous situation on Hwy 70, that there are drainage and driveway problems as stated in the 1986 rezoning request, that many uses are allowed in GC zoning districts that are not in harmony with the south side of the Hwy 70 neighborhood, and the Home Occupation permit method is more suited to a small beauty shop. ITEM #4a4: 129 East (4.31.B.10) Rezoning Request to rezone approximately 42,000 square feet from R-20/HD to OI/HD; The Board felt that OI is to be used as a buffer and that concept does not apply in this case. They asked Rigsbee to address the parking in the right-of-way and to look at the health club again wondering if it could be defined as a personal service. Also, to work with Barfield on the hours of operation if the health club is allowed. This should be done at the Zoning Permit stage. The Historic District Commission should review this. ITEM 4a5: Tuliptree Dr. and Locust St. Initial + Overlay District Zoning was presented by Rigsbee. ITEM #4a6: Riddle Ave. Initial + Overlay District Zoning was presented by Rigsbee. She stated that the area was under 10 acres as shown in the requirements. ITEM #4a7: Homemont Ave. Initial + Overlay District Zoning was presented by Rigsbee. She stated that the area was under the 10 acres as stated in the requirements. The Board asked her to combine these two streets into one district for further presentations. ITEM #4a8: Odie St. and Holiday Park Rd. North (Thompson Ct.) Initial + Overlay District Zoning was presented by Rigsbee. ITEM #4b9: A text change to the Zoning Ordinance to allow for mobile class- rooms was discussed. The Board felt there should be advance thought in the placement of mobile classrooms that would provide for screening from the public view. Also, that the children do need to have their esthetic sense educated and the mobile classrooms should be tasteful. The Board agreed that a new type of review by the Board of Adjustment (called the Sketch Plan Review) should be developed and applied to mobile classrooms, the fee for this review could be one-half of the Site Plan Review and other reduced standards could be used. Also, the Board felt that the mobile classrooms should be underpinned and only the Orange County Board of Education could use mobile classrooms. ADDITION: Rigsbee added a text change amendment to the agenda which could r , . Minutes, July 2, 1987 Page 4 read as follows: add section 5.8.3.f "Class A, B, and C units are allowed as a temporary residence when allowed by the Board of Adjustment in the form of a Conditional Use Permit as specified in section 4.16." ITEM #5: The Minor -,Subdivision of the John Harleton McKee property on Hwy 70 (4.6.A.1) was reviewed. The Board agreed with Rigsbee's recommendations which are: 1) the size of the lot appears to be wrong as the Orange County tax records show a parent parcel of 20.28 acres - this should be corrected and verified by Rigsbee before approval, 2) the lot width line scales to 148.5' feet at the setback line - the width should be 150' 3) label "utilities underground" 4) if one lot is 7.49 acres as stated on the survey,this lot should be shown on the survey, Health Department approval received, utility easment shown. There was also concern that the back 6.06 acre lot not become landlocked by any subdivision. ITEM #7: Rigsbee reported that the Town Board did not establish an Appearance Commission. The Board of Adjustment has been told this and they wish her to ask the Town Board again to establish an Appearance Commission so the new commission could prepare for adoption and implementation the Community Appearance Guidelines which are called for,and useful in,Site Plan Review. The Planning Board concurred with the Board of Adjustment and will join with the Board of Adjustment in requesting the Town Board to establish an Appearance Commission.
