RESOLUTION NO. 2007-147
A RESOLUTION: APPROVING AN INCREASE OF THE PERFORMANCE
GUARANTEE FOR ROUTE 7 AT RIVER CREEK P ARKW A Y
INTERCHANGE INTERIM GRADING AND UTILITY PLAN
WHEREAS, Council Resolution #2007-116 adopted on August 14, 2007, approved a
corporate surety bond from the Berkley Regional Insurance Company in the amount of
$3,169,000 as security to guarantee installation of public improvements as shown on plans
approved by the Director of Engineering and Public Works for the Rt. 7 River Creek Parkway
Interchange Interim Grading and Utility Plan; and
WHEREAS, Kettler, the developer of the Rt. 7 River Creek Parkway Interchange Interim
Grading and Utility Plan, has requested to add additional improvements to this plan and
construct more of the interchange using the Interim Grading and Utility Plan; and
WHEREAS, the additional improvements will increase the performance guarantee by
$1,000,000; and
WHEREAS, the Berkley Regional Insurance Company has approved and has issued a
rider to their surety bond #0122966 increasing the bond from $3,169,000 to $4,169,000; and
WHEREAS, the Director of Engineering and Public Works recommends approving an
increase of the performance guarantee from the Berkley Regional Insurance Company from
$3,169,000 to $4,169,000..
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:

The rider to corporate surety bond #0122966 from the Berkley Regional Insurance
Company increasing the performance bond from $3,169,000 to $4,169,000 is approved as
security to guarantee installation of the public improvements shown on plans approved by the
Director of Engineering & Public Works for the Rt. 7 River Creek Parkway Interchange Interim
Grading and Utility Plan.
PASSED this 23rd day of October 2007.
