HomeMy Public PortalAbout2007_10_23_r153 The Town of Leesburg, Virginia PRESENTED: October 23. 2007 RESOLUTION NO. 2007-153 ADOPTED: October 23.2007 A RESOLUTION: INITIATING AMENDMENTS TO THE LEESBURG ZONING ORDINANCE REGARDING EXCESSIVE OCCUPANCY WHEREAS, on July 1,2007 in Section 15.2-2286.A.5 of the Code of Virginia, 1950, as amended, the Virginia General Assembly established increased fines for any violation of provisions regulating the number of unrelated persons in single-family residential dwellings; and WHEREAS, it is the intent of Town Council to establish definitions and appropriate fines for the enforcement of excessive occupancy regulations in the Leesburg Zoning Ordinance; and WHEREAS, consideration of these amendments will enhance the effectiveness of the existing Zoning Ordinance; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments; and THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Amendments to the Zoning Ordinance are hereby initiated and referred to the Planning Commission to establish appropriate definitions, regulations and fines for excessive occupancy. SECTION II. The Planning Commission shall hold a public hearing to consider these amendments to the Zoning Ordinance, and report its recommendation to the Town Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
