Hau pbv askj John Forrei The Hillsborough Town Board and Planning Board will hold a Joint Public Hearing on Ninday, June 1-, 1987, 7:00 p.m. in the Hillsborough Town oarn,.101 E. Orange St., Hillsborough, N.C. to consider the following: Changes to the Zoning Map: 1. Rezoningg request by Tom Roberts and Melissa Thomas to rezone lots 4.38A..5 & 12 located on the east side of Virginia Cates Rd. from AR to R-20. 2. Rezoning request by Vern Larson to rezone lot 4.32.A.11A located on the northeast intersection of Hwy 70 and Holiday Park Rd. from R-20 to MF (Multi -family).* *NOTE: Plans available at Planning Department Changes to the Text of the Zoning Ordinance: 1. Amendment to section 5.19.2.a to change the square footage requirements from 14,520 to 7,260 square feet per unit for multi -family dwelling units. 2. Amendment to provide for correction of non-Aubstanttiveoerrors inn the.Zoning Ordinance, new section 11.13. 3. Amendment to.provide for special parking requirements in the CC zoning di$trict when a building is being replaced, Sectior, 6.1.b and 6.1.b.2. 4. Amendment to provide for the erection, removal and requiremer for political signs, new section 8.4.n. 5. Amendment to provide for Site -Plan Review on all non-resident lots regardless of lot size, section 5.18.2.b. 6. Amendment to the Permitted Use Table (section 3.4) to require Site Plan Review forthe following uses: Parking as Principal Use, Agricultural Sales & Service, Farm Equipment Sales & Service, Motor Vehicle Sales, Recreation Facilities (Profit a Non -Profit), Retail Sales & Rentals ..Beyond the Boundaries c the Zoning District, Manufacturing etc. Beyond the Zoning District Boundaries, Wholesale Sales. Also, to add the Tootr "S" to each page in Section 3.4. 7. Three alternative approaches for amending the Zoning Ordinanc as it regards mobile homes. Alternative #1 has requirements that allows no mobile homes that have a length exceeding thri times its width plus appearance requirements. Jack Smyr.e, Janet Rigsbee PRESENT: The meeting was convened at 6:30 p.m. but recessed at 7:0.5 to -7:30 so Rigsbee could attend a Town Board budget meeting. ADDITONS; Ashley asked that the signs of Walker Funeral Home and Couch Oil be discussed. MINUTES: Ashley moved to approve the minutes of the May 7, 1987 meeting. Moore seconded. Unanimous. z Ashley moved to approve the minutes of the. 10/28/86 meeting. Brody seconded. Unanimous. Brody moved to approve the minutes of the 11/6/86 after:the correction of the date. Ashley seconded. Unanimous. - 2EM #4.1: Rose offered a synopsis of the Public Hearing comments on the rezoning of lots 4.38A..5 & 12 from A -R to R-20 (aka Woodstone) and Rigsbee reading along with the minutes of the Public Hearing concurred with his synopsis. Rose noted that Rigsbee should contact Cheryl Wynn and several of the.neighbors when this project was at the subdivision stage. Rose read Rigsbee's prepared review and recommendations. Ashley moved to accept Rigsbee's recommendations and recommend approval of the rezoning. Cole seconded. Unanimous. ITEM #4.2: Rigsbee read the minutes of the Public Hearing pertaining to the rezoning of lot 4.32.A.11A from R-20 to MF (multi -family). Kenion asks about the petition that was submitted by the neighbors and Rose responded that yes 4 of 5 Town Board members must vote yea before the lot can be rezoned. Kenion reminded the Board that the density was debated in the'past and the Town Board rejected a higher than 3 units per acre density. Ashley agreed and said from past history the people of West Hills- borough did not want high density in their area. Page said that the Ordinance is a living document and changes will need to be made ' and there is a current need in Hillsborough for affordable housing. She also stated that this is a transition area and_a housing development here on Hwy 70 may help eliminate the current problem as seen in Durham on Hillsborough Rd. where there are so many driveways onto Hwy 70. Minutes, June 4, 1987, Page 2 Culbreth stated that the order of vote (1st for the rezoning and then for the text amendment to increase number of units) was not logical. The Board agreed that they would vote on the density text amendment first. Brody stated that Holiday Park Rd. is,::A cul=.de-sac- nd the r Ordinance requires a MF lot to be on 'a, -col -lector° �-or 'arterial. Rigsbee responded that it the lot. is'an Hwy 70.which is an arterial street. Page stated that there is a need in Hillsborough for a quality place where people at a teacher's income level could live. Ashley stated that there were 24 signatures on the petition and these are from current property owners who have bought property and probabl�r;,plan to stay there their entire life and they are trying to protect their property by si.gning.this petition. has Rose stated that he mixed emotions as he lives .in ..a.__s.ingle family area but understands that land =around-HiLls.borough.is at a premium. He feels that not everyone can -afford a single family house. He thinks that Hillsborough,needs. a better..:_. example of what good multi -family housing -can be. Rose recommended that the Board first vote on the text amendment. ITEM #5.1: Page moved to recommend approval to the Town Board of the text amendment which would require 7,260 square feet per unit for multi -family units. Davis seconded. Moore asked if this will hold for any area that is multi -family. Rose said yes. Vote 5.yeas, 4 nos, 1 abstention. Ashley, Brody, Moore, Murphy vote no. Rose abstained. Final vote 6 yeas to 4 nos. ITEM #4.2: Page moved that approval be recommended to the Town Board on the rezoning of lot 4.32.A.11A from R-20 to MF. Evans seconded. Vote 5. yeas, 4 nos, 1 abstention. Ashley, Brody, Moore, Murphy vote no. Rose abstained. Final vote 6 yeas to 4 nos. ITEM #5.2: Brody moved to to provide for Moore seconded. Unanimous. recommend approval to the Town Board of the amendment correction of non -substantive errors in the Ordinance, ITEM #5.3: Rigsbee read the amendment and recommended that because of present and future parking problems downtown that the Board ask the Town Board to authorize a parking study to be done and after it is finished to amend the Ordinance to require fees in lieu of parkin . Ashley moved to recommend approval to the Town Board with Rigsbee s suggestion of future parking study. Page seconded. Unanimous. ITEM #5.4: i Minutes, June 4, 1987, Page 3 Rigsbee read the amendment to provide for,the.:erection and control of political signs. Page asked that the time of erection be.reduced from 45 to. 30 days.- Rigsbee recommended that a sentence be-. a. ded.: that -.:provided for the removal of illegally placed signs land <aigns�-,that were. not.. removei in a timely manner. Page moved to recommend approval to the:Town: Board, with the change.) from 45 to 30 days and with a sentence authorizing -their -removal. Culbreth seconded. Unanimous. ITEM #5.5: Moore moved to recommend approval to the Town Board of the amendment to provide for Site Plan Review on all non-residential lots regardless of size. Ashley seconded. Unanimous. ITEM #5.6: Culbreth moved to recommend approval to the Town Board of the - amendment which would require certain uses:- -as -li-sted on _the amendment to be added to the uses which::require,Site Plan Approval._ 3 Ashley seconded. Unanimous. i ITEM #5.7: Rose asked the Board to observe -the prepared -boards on the wall that deal with the various proposals to amend:the Ordinance as it deals with mobile homes. Rose states that homes that are not HUD approved may have urea insulation, aluminum electrical systems, substandard hot water heater and other substandard construction qualities. He checked on updating a 1973 mobile home to 1976 (HUD) standards and the cost would be approximately $12,000. Rigsbee presnets her proposal which is taken from the Northern Orange Working Class Coalition's proposal with the main difference being that rather than allowing single-wides throughout the entire extraterritorial zoning area (which would be a big administrative problem and may get much negative reaction from the public) that smaller areas in the ETJ would be allowed to be rezoned to allow single -wide mobile homes. In each area zoned for mobile homes a certain percentage would already be mobile homes. Rose stated that 51% of existing homes should be mobile homes and then he feels that the property owners in the neighborhood would probably be at least 51% in favor of the rezoning. Evans asked that with the future annexation in the Northern Fairview area would areas rezoned for single-wides still be allowed to receive single-wides? Rigsbee responded that this will have to be written into the final amendment. Page was concerned about what is happening to Hillsborough and stated -that we are the number one trailer capital of N.C. Also that mobile homes do not pay as much taxes'as site built houses and we are doing the Town of of it's just due of tax monies. Rigsbee stated that another part of this amendment was to allow mobile homes for single family residences only. Minutes, June 4, 1987, Page 4 Rigsbee stated that it seems to be most fair to allow these newly zoned areas to be propo.sed for a period: -of 2 years 'without` charging the public fees for the rezoning There was discussion about what the new Coining �area''shoiild -be- called as ETJ does not accurately desct be -the atea"s--and,'MHD does not accurately describe the site"built-`houses ` than are = allowed. Rigsbee suggested calling the niW area°the + district as residential plus mobile homes are allowed there. Evans moved to recommend approval of Rigsbee's recommendation - to the Town Board. (see attachment for final amendment presented to Town Board based on the above discussion). Davis seconded. Unanimous. ITEM #5.8: Rigsbee asked that the Board consider"adding the word "Governmental" to the Recycling Materials Collection Center use in which case a Site Plan Review would not be a requirement:- Shesaid she had discussed this with Asst. County Manager,"Bill Laws, and he pointed out that this is a joint effort with Orange County and the Town of Chapel Hill. Page stated that she felt this was generally-a'good-thing but look at what the County did at North Hills Shopping Center without approval and this just proves that Site Plan Review is necessary. Rose recommended that fees be waived. -- Ashley moved to recommend approval to the Town -Board of the amendment that would add the use "Recycling Materials Collection Center" to the list of permitted uses in 0-I, GC, NB, GI, and AR zoning districts. Evans seconded. Unanimous. ITEM #5.9: Page moved to recommend approval to the Town Board that would allow special standards for recycling container sites that would allow for a base of gravel. Culbreth seconded. Unanimous. ITEM #5.10: Page moved to recommend approval to the*Town Board that would require Site Plan Review for Recycling Materials Collection Center. Ashley seconded. Unanimous. ADDITION: Ashley asked what could be done about Couch Oil and Walker's Funeral Home signs. Page responded that the Ordinance must be upheld and that Walker's went to the Bd. of Adjustment and his case was denied. He was told his next step was to appeal it to the Courts. .Rigsbee-stated that Walker's could redesign their lights so they would not shine into the public right-of-way by replacing the glass with opaque glass and then reapply to the Historic -District Commission ITEM #6: Page was appointed to the"Hillsborough Township Advisory Council of Orange County by acclimation. Minutes, June 4, 1987, Page 5 ITEM #7: All members received the minutes of the Subcommittee on - Subdivision Regulations. J ITEM #8: The Board agreed to start their regularly.''--scheduled-meetings:: ?> at 6:30 p.m. with no one dissenting.
