HomeMy Public PortalAbout2007_12_11_r176 Authorizing Ext of Utilities to High School Site on the O'Connor Tract The Town of Leesburg, Virginia PRESENTED:December 11.2007 RESOLUTION NO. 2007-176 ADOPTED: December 11. 2007 A RESOLUTION: AUTHORIZING EXTENSION OF WATER AND SEWER TO SERVE THE PROPOSED HIGH SCHOOL SITE ON THE O'CONNOR PROPERTY ON THE WEST SIDE OF ROUTE 15 BUSINESS WHEREAS, the Loudoun County School Board has selected a site for the next Leesburg area high school on a portion of the O'Connor property on the west side of the Route 15 Business opposite the entrance to Smart's Mill Middle School; and WHEREAS, public water and sanitary sewer from the Town of Leesburg are needed to service the proposed high school as described above; and WHEREAS, the Loudoun County School Board has requested the Town Council to authorize the extension of Town water and sanitary sewer to a proposed high school site on the O'Connor property on the west side of Route 15 Business opposite the entrance to Smart's Mill Middle School. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION 1. This resolution supersedes Resolution 2005-119. SECTION II. In order to facilitate the development of a proposed Leesburg area high school on a portion of the O'Connor property on the west side of Route 15 Business opposite the entrance to Smart's Mill Middle School, the Town Council hereby agrees to make available water and sewer service to the proposed high school, subject to the approval by the Town, the Loudoun County Public Schools, and the County, as appropriate, of an agreement setting forth the terms and conditions upon which such utility service shall be provided. SECTION III. Nothing herein shall be deemed to be a holding out by the Town as the sole water and sewer service provider outside its boundaries in this vicinity nor shall it operate as a commitment to provide such services to any party other than the Loudoun County Public Schools or for any purpose other than the purposes stated herein.
