A RESOLUTION: OPPOSING THE "MODIFIED D" ROUTE FOR THE VIRGINIA DOMINION
POWER TRANSMISSION LINES
WHEREAS, the Town of Leesburg supports the environmental protection of the Washington &
Old Dominion (W&OD) Trail; and
WHEREAS, the "Modified D" route is neither the preferred route of the applicant, Dominion
Virginia Power, nor the preferred route of the enormous majority of citizens from Loudoun County and
surrounding counties who have sent over 5000 comments to the Virginia State Corporation Commission
(SCe) in the proceeding calling for the final route to not be sited anywhere along the W &OD Trail; and
WHEREAS, the SCC is to determine the final siting of this transmission line, the Town of
Leesburg calls on the Commission to follow the proper and legal public policy decision making process
which should be to render a decision based on the routes proposed in the original application before the
SCC and not to render a decision based upon a route conjured up during the proceedings by the hearing
examiner who is not the applicant in this case.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The Town of Leesburg supports a resolution stating that the Virginia State
Corporation Commission must reject the November 28,2007 finding in the report of Hearing Examiner,
Howard P. Anderson, Jr. in Case #PUE-2005-00018 supporting his "Modified D" route.
SECTION II. The Leesburg Town Council calls on the Virginia State Corporation Commission to
support the preferred E-7 route ofthe applicant, Dominion Virginia Power.
