HomeMy Public PortalAbout2008_01_08_r003 TLSE 2006-0011 Leesburg Auto Park Structured Parking The Town of Leesburg, Virginia PRESENTED: January 8. 2008 RESOLUTION NO. 2008-3 ADOPTED: January 8. 2008 ARESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-0011, LEES BURG AUTO PARK PARKING STRUCTURE, TO PERMIT A PRIVATE PARKING STRUCTURE AS PART OF BUILDING 1 IN THE LEESBURG AUTO P ARK AT EAST MARKET STREET NEAR KEYSTONE DRIVE, SE WHEREAS, Landmark Realty Corporation has requested special exception approval to permit a private parking structure as part of Building 1 in the Leesburg Auto Park at East Market Street at Keystone Drive, SE; and WHEREAS, the property is located in the B-3 Community Retail/Commercial Zoning District; and WHEREAS, on December 6, 2007, the Planning Commission recommended conditional approval of this application; and WHEREAS, on January 8, 2008 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a private parking structure as set forth in the Zoning Ordinance; and WHEREAS, staff recommends approval, with the conditions set forth below. THEREFORE, RESOL VED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2006-0011, Leesburg Auto Park Private Parking Structure, East Market Street, SE, identified in the Loudoun County Land Records as Parcel Identification Number 149-46-0836, subject to the following conditions: Substantial Conformance: 1. Development of this special exception use shall be in substantial conformance with the Special Exception Plat titled "Special Exception TLSE-2007-0008 & TLSE-2006-0011 -2- ARESOLUTION : AP PRO VING SPECIAL EXCEPTION TLSE-2006-00 11, LEESBURG AUTO PARK PARKING STRUCTURE, TO PERMIT A PRIVATE PARKING STRUCTURE AS PART OF BUILDING 1 IN THE LEESBURG AUTO PARK AT EAST MARKET STREET NEAR KEYSTONE DRIVE, SE for Leesburg Auto Park" dated 9/18/06, revised through 10/26/07, prepared by Dewberry & Davis LLC. This plat inc1udes Sheets 1 of 8 (Cover Sheet); Sheet 2 of 8 (Existing Conditions Plat); Sheet 3 of 8 (Special Exception Plat); Sheet 4 of 8 (Special Exception Enlargement); Sheet 5 of 8 (Landscape Plan); Sheet 6 of 8 (Lighting Plan); Sheet 7 of 8 (Preliminary Utility and Site Grading Plan); Sheet 8 of 8 (Details and Sections); Sheet A.2-1 0 1 (Building 2 First Floor Plan); Sheet A3-lOl (Building 3 First Floor Plan) Sheet A3-102 (Buil ding 3 Second Floor Plan); and Sheet AA-lOl (Building 4 First Floor Plan). No Expressed or Implied Waivers: 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. Roof Top Lighting: Pole-mounted lights shall be prohibited on the top deck of the parking structure. Building 1 lighting fixtures shall be reviewed by the Board of Architectural Review in accordance with the conditions of approval for TLHP-2006-0066. P ASSED this 8th day of January 2008. ~l:~ .
