WHEREAS, it is the intent and desire of Town Council to achieve the development ofa diamond interchange at the intersection of Battlefield Parkway and Rt. 7 (East Market Street) as expressed in the Transportation Element of the 2007 Town Plan; and WHEREAS, it is the intent and desire of Town Council to encourage the development of structured parking facilities in the Town of Leesburg; and WHEREAS, the facility supports 130,680 square feet of general and medical office use which reinforces the Regional Office designation of the parcel under the 2005 Town Plan; and WHEREAS, Landmark Realty Corporation has requested special exception approval to permit a private structured parking facility in the southeast quadrant of E. Market Street and Battlefield Parkway, zoned I-I, Industrial/Research Park; and WHEREAS, on November 6,2007, the Planning Commission recommended approval of TLSE-2006-0012, 5-0-1-1; and WHEREAS, staff recommends approval of this request with the conditions set forth below; and WHEREAS, The Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception TLSE-2006-0012, Parkway Office Center, identified in the Loudoun -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-00 12, P ARKW A Y OFFICE CENTER, TO PERMIT A 4-STORY 320 SPACE PRIVATE PARKING STRUCTURE IN THE I-I INDUSTRIAL/RESEARCH P ARK ZONING DISTRICT. County Land Records as Parcel Identification Number(s) 149-45-7383-000 subject to the following conditions: 1. Substantial Conformance. This special exception shall be in substantial conformance with the special exception plat entitled "Parkway Office Center" Sheets 1-7, dated 11- 02-07 and prepared by Dewberry & Davis LLC. 2. No Waivers Expressed or Implied. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, site plans, and construction drawings are subject to applicable town regulations. 3. Russell Branch Parkway/Battlefield Parkway Design. Prior to the approval of the first Site Plan associated with this development the Applicant shall provide engineered drawings to the extent required to evaluate the impact to off-site properties in the immediate vicinity of the interim and ultimate condition of this area. Specifically, the applicant shall provide the required on-site right of way, reservations and related easements (temporary and permanent) to ensure both conditions can be constructed without excessive impact or cost to both the Town and the applicant (including disruption of future tenants). 4. Russell Branch Parkway/Battlefield Parkway Connection. The applicant shall (prior to occupancy of the first building constructed on this site) design, obtain Town approval of, bond and construct to substantial completion, the Russell Branch Parkway interim "at-grade" Tee Intersection with Battlefield Parkway in accordance with the following: ~ The design shall conform to the Town's final alignment for Battlefield Parkway per Dewberry's most recent drawings associated with the Town's design build project between Kincaid Boulevard and Route 7. ~ The design and construction shall include turn lanes as required for the "Tee" intersection including u-turn movements. ~ The applicant shall be responsible for any additional engineering costs associated with the interim "at-grade" intersection as noted above; if the additional engineering costs have been reimbursed by the owners of the Leesburg Auto Park development, this applicant shall be exempt from paying this additional cost. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2006-00 12, P ARKW A Y OFFICE CENTER, TO PERMIT A 4-STOR Y 320 SPACE PRIVATE PARKING STRUCTURE IN THE I-I INDUSTRIALIRESEARCH PARK ZONING DISTRICT. ~ The applicant shall be responsible for obtaining or for reimbursing the Town of Leesburg for any additional right of way or easements which may be required for this interim "at-grade" intersection; if these additional rights of way or easements have been obtained by or costs reimbursed by the owners of the Leesburg Auto Park development, this applicant shall be exempt from these acquisitions and or their associated costs. ~ The applicant shall construct or provide re-imbursement to the Town of Leesburg (if constructed by VDOT or the Town of Leesburg) for modifications to the Town's Battlefield Parkway plans to include but not be limited to the required median break, traffic devices (including complete signs and traffic signals), turn lanes, utility relocations, storm sewer, SWM, BMP, offsite grading, etc. to ensure all legs of this at- grade "Tee" intersection will function properly; if this specific construction has been completed by or costs reimbursed by the owners of the Leesburg Auto Park development, this applicant shall be exempt from these specific improvements and or their associated costs. 5. Russell Branch Parkway Off Site Improvements. If the right of way necessary for Russell Branch Parkway owned by Leegate LLC has not been acquired by others prior to Parkway Office Center site plan approval, the applicant shall secure said right of way and bond that portion of Russell Branch Parkway offsite, from the eastern right of way line of proposed Battlefield Parkway to the westernmost property line with Leesburg Auto Park. 6. Roof Top Lighting. Pole-mounted lights shall be prohibited on the top deck of the parking structure. Lighting fixtures shall be reviewed by the RA.R. in accordance with TLHP-2007-0024. 7. Right-of-Way Dedication and Easements. The applicant shall upon request of the Town provide the requested right of way and easements required for VDOT's design build contractor to construct the portion of Battlefield Parkway along the applicant's frontage 8. Diamond Style Interchange. Prior to the approval of any site plans related to this application, the Town must have written verification from VDOT stating that they will accept a diamond style interchange for this quadrant of the future Route 7 and Battlefield Parkway interchange. 9. Structured Parking. Applicant has not provided the specific amounts of medical and general office uses proposed on site but note that whatever the mix, it cannot exceed the 538 spaces shown on the special exception plat. 10. Board of Architectural Review. All conditions and clarifications of the Board of Architectural Review in its decision on July 16, 2007 must be met prior to site plan approval. 11. Multi-Use Trail. The applicant shall construct a 10 foot multi-use path within a 14 foot trail easement along the site's frontage on Battlefield Parkway and along the northern side of Russell Branch Parkway. 12. Parking Structure Landscaping. The top two levels of the northern face of the proposed parking structure facing E. Market Street shall have a "weeping" species of hardy plant material overhanging the edge of the structure in designed structural containers to provide aesthetic enhancement to the parking structure. The design of these structural plant containers shall be determined during site plan review and shall incorporate an artificial irrigation system. On the top level of the parking structure, flower boxes shall be installed open to rain irrigation. The choice of plant material shall be determined by the Town Urban Forester during site plan review. The approved plantings shall be installed following construction completion and prior to occupancy of the parking structure. PASSED this ~th day of January 2008.
