1. Oakdale Woods (4.44.A.9) Rezoning Request. Rezone 11.37 acre
from R-10 with a Conditional Use Permit for apartments to

new public road standards.

PLANNING BOARD MINUTES
SEPTEMBER 3, 1987

ITEM #1: Page moved approval of the August 6, 1987 minutes.
Culbreth seconded.
Unanimous.
ITEM #2: Brody asked to add an account of apparent violation on the Carl
ADDITIONS: Merritt property.
Rigsbee presented the Draft Copy of the new Soil & Erosion Control
manual of Ornage County and administered in the Town.
Rigsbee presented copies of the 1977 Land Use Plan.
ITEM #3: The Board discussed rules of procedure and the consensus was
to show the recommendation of the Planning Board and report
the number of votes to the Town Board. If a member would like their
name stated and his/her vote made known, the member should
so direct for that particular request.
The Board's consensus regarding Planning Board alternates was
to ask the Town Board to allow two alternates - one in -town the
other out-of-town. Whenever possible the in -town alternate
would replace an in -town member and likewise for out-of-town.
ADDITION: Rigsbee circulated the minutes of the Public Hearing of August
10, 1987.
ITEM #4-1: Culbreth moved to recommend approval of the rezoning request
for Oakdale Woods (44.A.9) an 11.37 acre lot rezoned from
R-10 to multi -family.
Brody seconded.
Unanimous.
ITEM 4-2: Rigsbee read her analysis and recommendations regarding the
rezoning of 128 W. Margaret Ln. (36.A.11) from R-20 to OI
which read as follows:
The problems in rezoning this property to OI are: 1. it does not
have direct access to a street classified as an arterial or collector -
street as required usually in the Application Criteria, this street
is the narrowest right-of-way in the original Town Plan; 2 OI uses
could generate significantly more traffic than residential�'use and
as the cars would have to back into Margaret Ln, it appears that this
would cause a safety -hazard; and 3. 6-7 parking spaces with screening
would be required - this would be difficu t to provide if rezoned now
and impossible to provide if side and rear setbacks were established
in the OI district.

PLANNING DIRECTOR'S RECOMMENDATION:
1. The real estate agent stress the Town's home occupation, Sectior
5.7 of the Zoning Ordinance, thus allowing for a single family
residence with accessory use.
2. The property owner plant screening along Margaret Ln. and the
east property line to soften the impact of the surrounding
commercial development.
3. The rezoning of this lot be denied.
The Board added that this would be an erosion of residential
property.
Cole moved to concur with the Planning Director's recommendations.
Moore seconded.
Unanimous.
ITEM #4- : Rigsbee read her analysis and recommendations regarding the
rezoning of 129 E. Tryon St. (old Piedmont building) (31.B.10)
from R-20 to OI which read as follows:
PLANNING DIRECTOR'S ANALYSIS: Points in favor of the rezoning ar.:o
that the building has had an OI use since 1946 and that an Oi zoninj
would allow for renovation that would require expansion of the
building. A point against is that this rezoning does not meet the
Application Criteria that says "the site would provide a buffer or
step down in intensity from a commercial use to a less intense use".
Phil Green from the Institute of Government said this would not be
spot zoning as this building has existed as an OI use for a long
period of time before zoning.
The Ordiance says that the Application Criteria will "usually be
applied" so this adds latitude to the criteria.
PLANNING DIRECTOR'S RECOMMENDATION:
1. Setbacks for side and rear be added to the OI district,
2. The property owner voluntarily have the soil tested for the
presence of PCB's,
3. The property owners be informed that parking spaces are not
allowed in the right -of -Way or setbacks except for occasional,
parellel parking,
4. The property owners request a preliminary design session with
the Historic District Commission before final plans are presente
to the Commission,
5. The property be rezoned to OI as requested.
The Board added that the N.C. Division of Archives and History
should be consulted for renovations. Rigsbee concurred.
Page moved to concur with the Planning Director's recommendation
with the addition of the consultation with Archives and History.

ITEM #4-6: Cole moved to recommend approval to add the + zoning to Riddle
Ave. and Homemont Ave.

ITEM #4-7: Cole moved to recommend approval to add the + zoning to Odie St..
and Thompson Ct (aka Holiday Park Rd. N.).
Culbreth seconded.
Unanimous.
ITEM #4-8: Page moved to recommend approval to amend the Zoning Ordinance
to change the date in section 5.8.3.e and to delete the section
after September 30, 1987 as presented.
Culbreth seconded.
Unanimous.
ITEM #4-9: Rigsbee read her recommendation to allow and set standards for
construction site trailers and mobile classrooms which included
new language regarding screening of mobile classrooms which read:
2. Mobile classrooms.... provided that they locate the mobile
classroom in the rear yard of the lot and plant a Type 1 screen
if they are visible from the right-of-way or neighboring property
owners.
Brody moved to recommend approval with Rigsbee's modification of
the screening requirements.
Cole seconded.
Unanimous.
ITEM #4-10:Cole moved to recommend approval to amend the Zoning Ordinance to
allow for any class of mobile home by adding a new section
4.16.1.f.
Culbreth seconded.
Unanimous.
ITEM #4-11:Culbreth moved to recommend approval of the new Flood Damage
Prevention Ordinance as presented by the Federal Government.
Murphy seconded.
Unanimous.
ITEM #6: The Board discussed the courtesy review of Occoneechee Point at
the southwest intersection of I-85 and Hwy 86. The areas of
concern were:
1. Water and sewer service should be voted upon by the Town
Board before recommendations would be given by this Board;
2. In light of the current water situation a.carwash may be
inappropriate;
3. Request a service road with only one exit onto Hwy 86, a
3 lane exit on the service road, a continuous left turn
land, a deceleration lane and interior road built to NCDOT
standards;
4. Landscaping at every 6th parking space as there is no
grouping of 10 spaces (at which number (10) landscaping is
required;
5. That evergreens be planted amongst the deciduous trees in the

buffer for foliage year round.
6. That a market analysis be performed - does traffic support
an 8 bay carwash, 8 gas pumps, a convenience store, motel;
7. In view that in the past the developer asked for satellite
annexation, that whenever possible to follow the Hillsbor-
ough Zoning Ordinance as the possiblity of annexation exists;
8. To be kept abreast of all changes in the development.
Culbreth moved to inform the Orange County Planning Department
of the above concerns.
Moore seconded.
Unanimous.
ITEM #7: The Board discussed new public road standards and felt that they
were needed on an interim basis until new Subdivision Regulations
were adopted.
Murphy moved to recommend to the Town Board that new subdivision
roads be constructed to NCDOT standards, that the developer pay
for engineer and inspection fees and that the roads be guaranteed
for a period of time.
Brody seconded.
Unanimous.
ADDITION: Brody wanted the Board to be aware of the situation on the
Carl Walters lot on the east side of Hwy 86 north of I-85 in
Orange County's jurisdiction. Chandler Concrete is dumping the
slurry from the concrete trucks over the bank and it is
hardening on the bank and in the stream thus blocking the stream.
Walters claims he is enlarging the parking lot but her field
observation showed that this was not the case.
