A RESOLUTION APPROVING CERTIFYING PAST DUE SEWER FEES AS PAST DUE TAXES
AND AUTHORIZING A TAX LIEN BE PLACED ON CERTAIN RESIDENTIAL PROPERTY
IN THE CITY OF RIVERDALE, IOWA
WHEREAS, The City of Riverdale, Iowa ("City") is a Municipal Corporation, organized and
operating under the laws of the State of Iowa, and;
WHEREAS, City Staff has made several attempts to collect delinquent sanitary sewer
fees from the deedholder of 1 147 Fenno Drive (Francisco Duque) since 2013, and;
WHEREAS, the total of past -due service fees and late charges totals $144.94, and;
WHEREAS, the deedholder was notified by written correspondence (EXHIBITS A and B)
that a tax lien would be filed on the subject property if no effort was made to either pay
the past -due fees or contact City Staff to make other arrangements.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE,
IOWA.
Section 1. The City Council of Riverdale hereby agrees that sufficient written notice
was given to the deedholder and reasonable accommodations were offered to allow
for the payment of past -due fees;
Section 2. The total amount due to the City should be certified as past -due taxes
owed to the City of Riverdale by Francisco Duque, his estate, heirs and assignees; and
Section 3. Instructs City Staff to proceed with collection of past due fees and service
charges through the imposition of a tax lien on the subject property and to pursue
collection through any means deemed reasonable by staff until the matter is fully and
satisfactorily settled.

To Whom It May Concern:
We attempted to contact you about your unpaid sewer bill in January and did
not receive a response. We have now completed our quarterly sewer billing and the total
due on your account is currently $144.94. Your bill is included with this letter for your
reference.
Under the City of Riverdale's Code (Chapter 95; Section 140), the property owner
is responsible for all delinquent sewer service payments and the grace period. extended
to you to make your payment has long since expired. As stated in the letter to you from
our Interim City Administrator, Lisa Kotter, failure to pay will result in a lien being
placed on your property.
This letter serves as notice of our intent to file that lien on or before the end of the
month of April.
It's entirely possible you may have missed our ealier correspondence. And if
that's the case, we're sorry if this comes as a bit of a shock — but the bill is due and needs
to be paid. Unfortunately, due to the COVID-19 outbreak, the City's offices are closed to
the general public, so stopping by City Hall to make your payment isn't really a viable
option — you need to mail your payment in to us within the next week to avoid having
the lien filed.

To Whom It May Concern:
On April 15, 2020, I made a final attempted to contact you about your unpaid
sanitary sewer account for your home in Riverdale and did not receive a response. In
that letter, I advised you that the total due on your account was $144.94 and that failure
to pay would result in a lien filed against your property.
Under the City of Riverdale's Code (Chapter 95; Section 140), the property owner
is responsible for all delinquent sewer service payments and all grace periods extended
to you to make your payment have long since expired.
This letter serves as notice that we sent the paperwork required to obtain the tax
lien against your home was sent to the Scott County Treasurer this past week.
There is still time to avoid this financial encumberance. You need to mail your
payment in to us as soon as possible to avoid any further action. Please send a check or
money order to:
