HomeMy Public PortalAboutr 96:021 Dine of Adopti(m--JANUARY 18, 1996 No. 96-21 AUTHORIZING AGREEMENT FOR EXTRAORDINARY, UNSPECIFIED SERVICES WHEREAS, there exists a need for Insurance Coverage; and WHEREAS, the maximum amount of the contract in question is $40,552 for Comprehensive Law Enforcement Policy and $20,825 for Public officials Liability, and Funds are available in an appropriations entitled Insurance and Surety Bond Premiums and have been Certified by the Chief Finance Officer, said certification being attached; and WHEREAS, N.J.S.A. - 40A:ll-1 et seq. requires that the Resolution authori'zing the Award of Contracts for "Extraordinary, Unspecifiable Services" without competitive Bids and the Contract itself must be available for public inspection; and WHEREAS, Patrick J. DeBlasio has Certified that this meets the Statute and Regulations governing the Award of said Contracts; NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Carteret as follows: 1. The Mayor and Borough Clerk are Hereby Authorized and Directed to Execute the attached Agreement with Firm, Inc. 2. This Contract is awarded without competitive bidding as an "Extraordinary, Unspecifiable Service" in accordance with 40A:11-5 (1) (a) (ii) of The Local Public Contracts Law because Insurance including the Purchase of Insurance Coverage are specifically excluded. 3. DeBlasio, CFO Re: Contract for: Insurance Coverage- Comprehensive Law Enforcement Policy and Public Officials Liability This is to request your approval of a Resolution authorizing a contract to be executed as follows: Firm: Firm, Inc. Cost: $40,552 - Comprehensive Law Enforcement Policy $20,825 - Public Officials Liability Period: January 1, 1996 thru December 31, 1996 Purpose: Insurance Coverage for Comprehensive Law Enforcement Policy and Public Officials Liability. This is requested to be awarded without competitive bids as an extraordinary, unspecifiable service (N.J.S.A 40A:11-5 (1) (a). I do hereby certify as follows: 1. Quotations have been solicited and are as follows: Firm, Inc. $20,825 (Public Officials) $40,552 (Law Enforcement) Boynton & Boynton $19,360 This is the lowest quotation. (If not, explain why in detail) Firm, Inc has serviced this policy for many years. Based on Firms past experience and reputation, the award was offered to Firm. The 1996 General Liability & Property Coverage was offered to Boynton & Boynton. At this time, the insignificant price differential did not warrant this policy to also be awarded to Boynton & Boynton. 2. Insurance coverage is specialized and qualitative in nature requiring expertise, extensive training and proven reputation. Insurance contracts have been modified over the years to conform to Borough requirements and policies. 3. This can not be described by written specifications because: It is not reasonably possible to draft specifications to meet the Borough requirements of all the various liability coverage and administration thereof. 4. I have reviewed the rules and regulations of the Division of Local Government Services as contained in the local public contract guidelines (revised) and certify that the proposed contract may be considered as an extraordinary, unspecifiable service in accordance with the requirements thereof.
