JOINT PUBLIC HEARING
JANUARY 26, 1988

ITEM r1: To consider a Change to the Zoning Map. A request by Roger
Dale Stephens to add the + overlay district to lots on the
west side of Buttonwood Dr. and the east side of Latta Rd.
(see map) This + overlay zoning district would allow Class B
single -wide mobile homes on vacant land. (attachments)
ITEM #2: To consider a Change to the Zoning Map. A request by Willie
Laws to rezone a 5.4 acre parcel on the east side of Highland
Loop Rd. from R-20 to GC (General Commercial). (attachments)
Item #3: Text Change Amendments to Section 6 "PARKING". (attachments)
ITEM #4: Text Change Amendments to add buffer requirements along
Interstate I-85 and I-40. (attachment)
ITEM #5: Street Classification Systment - to designate streets as
collector, arterial, and local. (map at Town Hall)
ITEM #6: Park Plan to designate existing and potential park areas.
(map at Town Hall)
ITEM #7: Presentation of proposed Subdivision Regulations. Orange
County's regulations were used as a model with changes to
accomodate Town needs and policies. (Text at Town Hall).
As much time and money has been spent on advertising and
notification, it is essential that you notify Janet Rigsbee
as soon as possible if you will not be able to attend this

ITEM #1: The proposed Rezoning Request by Roger Dale Stephens to add the
+ overlay zone to lots on the west side of Buttonwood Dr. and the
east side of Latta Rd. (see map for exact area) was presented by
Rigsbee. Rigsbee explained the area that would be affected, the
current uses in that area, and the application criteria imposed
by the Zoning Ordinance to rezone to a + overlay district.

Rigsbee read a letter of opposition to the rezoning that was
signed by 20 persons and said that she had received one phone call
in support of the request and one phone call in opposition.
Edna Ellis read a letter signed by James & Mary Fox in opposition
4 to the request (see file).
W.L. Caviness opposed the rezoning as he feels that it lessens
property value and that mobile homes are a nuisance.
Donald Pittman feels that it is true that mobile homes devalue the
property and also he feels that they increase the crime rate.
Len Bultema said that he put alot of hard labor into his home and
he agrees that it decreases property values and lessens the tax
base. He feels that there is no advantage except for the developer
and that the Town should provide areas that are for stick built
homes only.
Chris Ely presented photos of the area (see file) and read a
letter in opposition with 41 signatures (see file).
Patricia Coleman asked to leave the zoning as it is and that
owner occupied housing should be a priority not rental units.
Walter Floyd and Vernon Clark said they agreed with the opposition.,
Carleton McKee owns all the land bounding the proposed + district
and he wants no mobile homes on his lands in the future.

David Parker is opposed to the rezoning.
Len Bultema asked what criteria does the Board use to judge a
rezoning request and Culbreth responded the criteria in the
Zoning Ordinance. Bultema asked if the Zoning Ordinance could be
amended to allow for only stick built homes.
Poole -Kober asked if any of the letter of opposition were protest
petitions and Rigsbee said no. She then asked if there could be
a show of hands of persons in opposition to the request. 35 persoi
raised their hands.
Robert Whitesell asked the Boards to take time to ride up Button-
wood Dr. and see the nice homes there and to see the mess of the
existing mobile homes.
ITEM #2: The proposed Rezoning Request by Willie Laws to rezone 5.4 acres
from R-20 to GC was presented by Rigsbee. Rigsbee explained the
area that would be rezoned, the uses that could be allowed if it
were rezoned to GC, and the application criteria imposed by the
Zoning Ordinance to rezone a lot to GC.
Willie Laws spoke to the commercial uses in his area and said that
he needed help to get this property rezoned.
John Hilton asked to approve the rezoning as there already is much
commercial on Highway 70.
Guy Baldwin said there is a steady expansion of St. Mary's Rd and
Hwy 70 it is very busy at Laws' residence so he is for the rezoning
Laureen Turner is in favor of rezoning.
Helen Robinson lives in her mother's house and said that if the
lot were rezoned that a commercial use would be in her mother's
backyard and would change the complexion of a quiet, residential
neighborhood and ruin their privacy. She is against the rezoning.
Herbert Allen lives on Hwy 70 and has seen the traffic increase
in the last 17 years and is for the rezoning.
Mary Ballard would hate to see it rezoned commercial because once
Mr. Laws sold the property he couldn't help what could be put on
the property.
James McGhee said he is a friend of the Laws' and he feels that
Hwy 70 is going to open up and he is for the rezoning.
Jack Knight lived on Highland Loop Rd. since 1953 and he said he
has invested money in a home that suits his personality. They
live on a quiet 30' wide private road. If the lot is rezoned to
GC.then other lots will asked to be rezoned, if the lot stays
R-20 then homes will be put up there. The extra traffic could
affect resale value and change the solitude of the neighborhood.
He opposes the rezoning.

Willie Laws said that the land available on the 5.4 acre lot will
not perk as he has tried to get it perked. If it would perk he
would love for his son to live there. He feels like he is on
Broadway as the headlights shine into his windows.
Bill Crowther said that Highland Loop Rd. is a nice place to live.
He respects the right to rezone property but then the headlights
would be in his window. He prefers the zoning to remain as is.
Horace Johnson said that the intersection is designated as a
commercial node in the Pantry area study.
Tommy Merritt said that there are alot of businesses on the south
side of Town and that is a burden on Churton St. He is in
favor of the rezoning.
Willie Laws presented 17 letters (see file) in favor of the
rezoning request.
BREAK: The Mayor received a report on a standing violation at the
sewer treatment plant.
ITEM #3: Rigsbee reviewed the changes that were proposed for the parking
section of the zoning ordinance.
ITEM #4: Rigsbee reviewed the new section on buffers along the interstate
highways. She said that the Triangle J Council of Governments
has reviewed the addition and it meets their standards.
Neal Littman said that he is in favor of the buffer requirements
and also of the parking changes and he supports their adoption.
ITEM #5: Rigsbee explained the Road Classification System.
ITEM #6: Rigsbee explained that a Parks Advisory Council will be needed to
review "subdivisions and ensure that they meet the recreation
standards of the Subdivision Regulations. She explained
the recreation -standards of the proposed subdivision regulations.
Rigsbee noted areas on the Park Plan that would be used for Park
purposes. These are all areas already owned by the Town or the
County.
Poole -Kober asked if the Town lot at King, Occoneechee and
Margaret Sts, could be designated park space.
ITEM #7: Rigsbee explained that the Subdivision Regulations are taken from
Orange County's and edited to fit the needs of the Town. She
distributed this first draft to the Town Board members, to,sdme
Planning Board members, to the Town Attorney, to Rich Ducker,
to Brian Benson, and to Marvin Collins. With their input she
produced the 2nd draft which is the 1st draft with changes noted in
red and this 2nd draft is what she is bringing to Public Hearing.
Mayor Cates said that he had talked with Bob Rose and Rigsbee
and they were in agreement that the Subdivision Regulations were
in good form and that any changes that might be needed in the futur
could be taken care of as amendments.

The Town is still awaiting comments from the Orange County
Board of Commissioners.
The Public Hearing ended.
The Mayor reported and distributed a letter to the Town Board
from OWASA.
Commissioners Smith and Johnson had attended a meeting held in
Chapel Hill dealing with the management of water supply for a
large regional area and they reported on this meeting.
