A RESOLUTION: URGING THE VIRGINIA STATE HOUSE OF DELEGATES TO CONTINUE
SENATE BILL 768ES2 TO THE 2009 SESSION
WHEREAS, Senate Bill 768ES2 seeks to replace the current cash proffer system with a system of
impact fees; and
WHEREAS, Senate Bill 768ES2 caps the impact fees for houses and commerciaVindustrial
impact fees at an unacceptable level; and
WHEREAS, Senate Bill 768ES2 shifts the burden of paying for growth to citizens who pay real
estate taxes rather than allowing growth to pay for itself; and
WHEREAS, Senate Bill 768ES2 repeals municipality's authority to accept voluntary cash
proffers from new residential projects; limits authority to accept off-site non-cash proffers; and limits the
amount of impact fees a locality can impose; and
WHEREAS, Cities and Towns could benefit from a healthy impact fee system, since the
adjoining counties could rezone for higher density residential and commercial near the city or town;
however, Senate Bill 768ES2 in its current form will not promote that result.
THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby urges
the Virginia State House of Delegates to continue Senate Bill 768ES2 to the 2009 session to allow for
more study.
