HomeMy Public PortalAbout2008_02_26_R041 The Town of Leesburg, Virginia RESOLUTION NO. 2008-41 PRESENTED: February 26. 2008 ADOPTED: Februarv 26. 2008 A RESOLUTION: INITIATING VARIOUS AMENDMENTS TO THE ZONING ORDINANCE FOR ARTICLE 3 REVIEW AND APPROVAL PROCEDURES, ARTICLE 5 RESIDENTIAL ZONING DISTRICTS, ARTICLE 9 USE REGULATIONS, ARTICLE 15 SIGN REGULATIONS AND ARTICLE 17 ENFORCEMENT AND PENAL TIES OF THE LEESBURG ZONING ORDINANCE WHEREAS, on February 25,2003 the Town Council adopted a comprehensive revision to the Zoning Ordinance; and WHEREAS, through daily use of the 2003 Zoning Ordinance items have been identified that should be amended to better clarify certain sections of that ordinance; and WHEREAS, additional uses and use limitations have been identified that will give more flexible commercial and residential opportunities to the citizens of Leesburg; and WHEREAS, the Virginia General Assembly established increased fines for any violation of provisions regulating the number of unrelated persons in single-family residential dwellings that should be incorporated into the Zoning Ordinance to aid enforcement; and WHEREAS, consideration of these amendments will enhance the effectiveness of the existing Zoning Ordinance; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION 1. The following amendments are hereby initiated and referred to the Planning commission for recommendation: -2- A RESOLUTION: INITIATING AMENDMENTS TO ARTICLES 3, 5, 9,15 AND 17 OF THE LEESBURG ZONING ORDINANCE 1. Amendments to Article 17 to increase the fines for violations of provisions regulating the number of unrelated persons in single-family residential dwellings in accordance with SectionI5.2-2286.A.5 of the Code of Virginia, 1950, as amended. 2. Amendments to Article 9 and Article 15 to provide regulations and performance standards for specified temporary business special events. 3. Amendments to Article 15 to increase the square footage permitted for temporary political signs. 4. Amendments to Article 9 to establish appropriate definitions, regulations and standards regulating employees for home occupation uses. 5. Amendments to Article 3 and Article 5 to establish definitions, regulations and standards regulating affordable dwelling units in residential zoning districts. 6. Amendments to Article 3 to permit administrative approval of minor modifications to approved rezoning concept plans or proffers and approved special exceptions subject to certain standards and conditions. SECTION II. The Planning Commission shall hold a public hearing to consider these amendments to the Zoning Ordinance on March 20, 2008 and shall report its recommendation to the Town Council pursuant to Chapter 22, Title 15.2-2204 of the 1950 Code of Virginia, as amended.
