HomeMy Public PortalAbout2008_03_11_R048 TLSE 2007-0010 Chevy Chase Bank The Town of Leesburg, Virginia PRESENTED: March 11.2008 RESOLUTION NO. 2008-48 ADOPTED: March 11. 2008 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-001O, CHEVY CHASE BANK DRIVE-THROUGH LOCATED AT 401 EAST MARKET STREET, SE. WHEREAS, Chevy Chase Bank, F.S.B. has requested special exception approval to permit a two-lane drive-through as part of the proposed bank at 401 East market Street, SE; and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on March 6, 2008 the Planning Commission deadlocked on a motion to recommend denial voting 3-3-1 (absent); and, did not forward a recommendation to Town Council; and WHEREAS, on March 11,2008 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a bank drive- through facility as set forth in the Zoning Ordinance; and WHEREAS, staff recommends denial. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2007-0010, Chevy Chase Bank Drive-Through, 401 East Market Street, SE, identified in the Loudoun County Land Records as Parcel Identification Number 231-10-9897, subject to the following conditions: Substantial Conformance: 1. Development of this special exception use shall be in substantial conformance with the Special Exception Plat titled "Chevy Chase Bank at East Market Street" dated June, 2007, revised through 1/11/08, prepared by BC Consultants. This plat includes Sheet 1 -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-00IO, CHEVY CHASE BANK DRIVE-THROUGH LOCATED AT 401 EAST MARKET STREET, SE. of 4 (Special Exception Plat); Sheet 2 of 4 (General Notes and Details); Sheet 3 of 4 (Preliminary Rough Grading Plan); Sheet 4 of 4 (Site Photometric Plan) No Expressed or Implied Waivers: 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Council or as shown as approved by Town Council on the Special Exception Plat and supporting documents. Site Lighting: 3. All lighting fixtures used to illuminate outdoor areas shall be designed and directed on- site to avoid glare in surrounding areas in accordance with Design and Construction Standards Manual Section 7-670 and Zoning Ordinance Section 12.11. Speaker Volume: 4. Speakers used in the drive-through shall not emit sound levels in excess of the maximums established in Zoning Ordinance Section 7.9.3. Verification of speaker volume in compliance with Zoning Ordinance limitations shall be provided prior to site plan approval. Landscaping: 5. The existing chain link fence along the eastern boundary shall be removed from this buffer area. A six-foot brick wall shall be erected on the subject property. 6. Board of Architectural Review approval is required for the proposed six-foot brick wall prior to site plan approval. 7. The plant mix depicted on the plan in the eastern and southern buffer yards are acceptable alternatives to the standard buffer materials found in Zoning Ordinance Section 12.8.6.D.due to the presence of overhead utilities along the east and storm water easement along the south. Final determination of plant species shall be made prior to site plan approval. 8. In order to better comply with the goals of the Crescent District Master Plan to place buildings at the street, a modification of Zoning Ordinance Section 12.8.2.G.2.2. is recommended to allow a 20-foot setback along the Catoctin Circle frontage as depicted -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-00IO, CHEVY CHASE BANK DRIVE-THROUGH LOCATED AT 401 EAST MARKET STREET, SE. on the Special Exception Plat. Final determination of plant species shall be made prior to site plan approval. E. Market Street Driveway: 9. The East Market Street driveway shall be restricted to right in/right out movements only. A raised curb island "pork chop" shall be constructed in the entrance at the direction of the Department of Engineering and Public Works that is in substantial conformance with the Chief of Engineering's sketch dated January 22, 2008 found in Attachment 8 to Attachment A of the March 11, 2008 staff report. Drive-Through Canopy: 10. The service point for drive-through aisles shall be moved towards the end of the building away from the East Market Street entrance to permit all required stacking spaces behind the service point and out of the drive-through entrance. The drive-through canopy shall be relocated in accordance with the sketch dated 3/10/08 by BC Consultants. Armored Vehicle Service 11. In order to not block circulation into or out of the parking area, armored vehicles shall not park or stand in any travel aisle while servicing the bank.
