HomeMy Public PortalAbout2008_03_25_r049 TLSE 2007-0005 Offices @Georgetown Park Private Parking Structure The Town of Leesburg, Virginia PRESENTED: March 25. 2008 RESOLUTION NO. 2008-49 ADOPTED: March 25. 2008 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0005, OFFICES AT GEORGETOWN PARK, TO PERMIT A PRIVATE PARKING STRUCTURE IN THE B-1 COMMUNITY (DOWNTOWN) BUSINESS ZONING DISTRICT. WHEREAS, it is the intent and desire of Town Council to encourage the development of structured parking facilities in the Town of Leesburg; and WHEREAS, the proposed parking structure would support 52,000 square feet of general uses which reinforces the Downtown Land Use designation of the parcel under the 2005 Town Plan; and WHEREAS, Waterford Leesburg II L.L.C. has requested special exception approval to permit a private structured parking facility in the northeast quadrant of the intersection of South Street, S.W. and Wirt Street, S.W., zoned B-1, Community (Downtown) Business District; and WHEREAS, on February 7, 2008, the Planning Commission recommended approval of TLSE-2007-0005 by a vote of 6-1; and WHEREAS, staff recommends approval of this request with the conditions set forth below; and WHEREAS, The Council has concluded that the.approval of the application would be.in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby approves Special Exception TLSE-2007-0005, Offices at Georgetown Park, identified in the Loudoun County Land Records as Parcel Identification Number 231-37-6803-000 subject to the following conditions: -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0005, OFFICES AT GEORGETOWN PARK, TO PERMIT A PRIVATE PARKING STRUCTURE IN THE B-1 ZONING DISTRICT. 1. Substantial Conformance. This special exception shall be in substantial conformance with the special exception plat entitled "Offices at Georgetown Park Special Exception Plat (Structured Parking)", Sheets 1-8, dated March 1,2007 revised through 2/19/08 and prepared by Bowman Consulting. 2. No Waivers Expressed or Implied. Approval of this special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual, except as may have been approved as part of this application. Final plats, site plans, and construction drawings are subject to applicable town regulations. 3. Maximum Nonresidential Use Square Footage. The maximum nonresidential use square footage of the proposed building (excluding the. parking area) shall not exceed 51 ,447 square feet and may decrease based on final building design approval by the B.A.R. 4. Building Design. The Applicant shall design the building's southern and western facades to incorporate architectural elements (e.g., multiple entranceways, stoops, belvederes or colonnades) as shown on Sheet 5 of the Plat to more appropriately integrate the adjacent public realm comprised of Town Branch, the W &OD Trail and Georgetown Park. Final architectural elevations are subject to review and approval by the Board of Architectural Review. 5. Loading Space Waiver. Additional information regarding the loading space waiver request must be submitted at time of site plan submission to demonstrate that an on- street loading space can be accommodated on the property's Wirt Street frontage. 6. Stormwater Management. Applicant shall revise the "SWM/BMP Narrative Concept" on Sheet 7 to state that all final BMP and stormwater management design criteria shall be in accordance with the Design and Construction Standards Manual and the Virginia Stormwater Handbook. Approval of this application shall not constitute an approval of the methods of BMP and stormwater management stated by the Applicant on Sheet 7. 7. Wirt Street Improvements. The Applicant shall provide full frontage improvements on Wirt Street as shown on Sheet 6 of the Plat including curb, gutter and sidewalk with a minimum 22-foot travelway (face of curb to face of curb), relocation of overhead utility lines and the elimination of the shift in the road at the northwestern property boundary. Where the parallel parking and off-site loading space are installed a 28-foot minimum travelway shall be provided. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0005, OFFICES AT GEORGETOWN PARK, TO PERMIT A PRIVATE PARKING STRUCTURE IN THE B-1 ZONING DISTRICT. 8. South Street Improvements. The Applicant shall provide full frontage improvements on South Street as shown on Sheet 6 of the Plat including right-of-way dedication if necessary, curb, gutter and sidewalk with a minimum 22-foot travelway (face of curb to face of curb). If parallel parking is installed a 28- foot minimum travel way shall be provided. 9. Green Building Elements. The Applicant will incorporate green building elements into the by right office building and will (a) use brick that is manufactured within 500 miles; (b) employ a LEED-certified architect: (c) install an energy efficient heating system; (d) install Low-E glass windows; (e) utilize fluorescent lighting; (t) paint with low- VOC paint; (g) install low- VOC carpet; (h) install low-flow toilets; and (i) irrigate landscaping with recycled water. 10. Bicycle Racks. Applicant shall provide a minimum oftwo bike racks on the property, the location of which shall be determined prior to site plan approval. The applicant will also provide on-site showers as a part of the building design. 11. Use Limitation. The private parking structure shall be used solely for the parking of vehicles in operating condition. No motor vehicle parking repair work except emergency service shall be permitted in association with a parking facility. 12. Public Access to Garage and Parking.
