HomeMy Public PortalAbout2008_03_25_r050 TLSE 2007-0012 Gods Children Learning Center The Town of Leesburg, Virginia PRESENTED: March 25.2008 RESOLUTION NO. 2008-50 ADOPTED: March 25. 2008 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0012, GOD'S CHILDREN LEARNING CENTER TO AMEND SE#2002-02 PERMITTING CHILDREN UP TO AGE 12 AT THE CHILD CARE FACILITY LOCATED AT 101 DAVIS AVENUE, SW. WHEREAS, Patricia Bennett, proprietor of God's Children Learning Center, has requested an amendment of special exception application SE#2002-02 limiting the ages of children at the child care facility to ages 2.5 to 5 years old. Ms. Bennett seeks to permit children up to age 12 in accordance with State licensing for the facility at 101 Davis Avenue, SW; and WHEREAS, the property is located in the B-2 Established Corridor Commercial Zoning District; and WHEREAS, on February 21, 2008 the Planning Commission recommended conditional approval of this application; and WHEREAS, on March 25, 2008 the Town Council held a public hearing; and WHEREAS, the proposed use meets the special exception standards for a child care facility as set forth in the Zoning Ordinance; and WHEREAS, staffrecommends.approval, with the conditions set forth below. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2007-0012, God's Children Learning Center, 101 Davis Avenue, SW, identified in the Loudoun County Land Records as Parcel Identification Number 232-35-9476, subject to the following conditions: -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0012, GOD'S CHILDREN LEARNING CENTER TO AMEND SE#2002-02 PERMITTING CHILDREN UP TO AGE 12 AT THE CHILD CARE FACILITY LOCATED AT 101 DAVIS AVENUE, SW. Substantial Conformance 1. Continuation of this special exception use shall be in substantial conformance with the Preliminary/Final Development Plan Special Exception Plan titled God's Children Learning Center dated February, 2004, revised through 8/17/04, prepared by Bowers and Associates, Ltd. approved under TLPF-2004-02. No Expressed or Implied Waivers 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Councilor as shown as approved by Town Council on the Special Exception Plat and supporting documents. Hours of Operation 3. The hours of operation when childcare will be provided on -site shall be restricted to 6:00 a.m. - 6:30 p.m. Monday through Friday, and shall be closed on all recognized Federal holidays. Landscape Buffers 4. All site landscaping shall be provided and maintained as shown on the Landscape Plan provided as part of the approved Preliminary/Final Development Plan dated 8/17/04. Maximum Number of Children and Age Range 5. No more than 49 children shall be enrolled at the facility. [All children will be between the ages of2.5 to 12 years of age]. Maximum Number of Children in the Play Area 6. No more than 10 children shall be outside in the play area at a time. State Licensing Shall be Maintained 7. The applicant and the child care center shall meet and remain in compliance with all applicable state licensing requirements. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0012, GOD'S CHILDREN LEARNING CENTER TO AMEND SE#2002-02 PERMITTING CHILDREN UP TO AGE 12 AT THE CHILD CARE FACILITY LOCATED AT 101 DAVIS AVENUE, SW.
