A RESOLUTION: AMENDING THE FY 2008-2012 CAPITAL IMPROVEMENT
PROGRAM FOR STREETS AND HIGHWAYS TO INCLUDE
CONSTRUCTION OF BATTLEFIELD P ARKW A Y BETWEEN
T A VISTOCK DRIVE AND KINCAID BOULEV ARD, APPROVING
CHANGE ORDER NO.8 (KINCAID FOREST) FOR THE SYCOLIN
ROAD WIDENING PHASE I-A PROJECT, AND AUTHORIZING THE
TOWN MANAGER TO EXECUTE IT
WHEREAS, the Sycolin Road Widening Phase I-A is a funded capital project currently
under construction; and
WHEREAS, Sycolin Road Widening Phase I-A constructs Battlefield Parkway from
Sycolin Road to Tavistock Drive; and
WHEREAS, Kincaid Forest is a townhouse development proffered to construct Battlefield
Parkway between Tavistock Drive and Kincaid Boulevard; and
WHEREAS, Battlefield Parkway between Tavistock Drive and Kincaid Boulevard will be
the only remaining missing link between the Greenway and Market Street after completion of the
VDOT project (Kincaid to Route 7); and
WHEREAS, this particular segment of Battlefield Parkway is not scheduled for
construction until the 13th occupancy permit is requested by the developer of Kincaid Forest in
accordance with Proffer B.l of TLZM-2004-0006; and
WHEREAS, the developer's proffers allow "Cash in Lieu of Construction"; and

CHANGE ORDER NO.8 (KINCAID FOREST) FOR THE SYCOLIN
ROAD WIDENING PHASE I-A PROJECT, AND AUTHORIZING THE
TOWN MANAGER TO EXECUTE IT
WHEREAS, if the Town constructs this road for the developer, the total actual cost will be
escalated from the time of completion until payment is made by the developer in accordance with
proffer interpretation dated December 19,2007; and
WHEREAS, the total payment by the developer cannot exceed $1.1 million in accordance
with Profer D ofTLZM-2004-0006; and
WHEREAS, sufficient funds are available in the Sycolin Road Widening Phase I-A project
to issue this change order if the developer doesn't pay up front; and
WHEREAS, the requested Change Order No.8 (Kincaid Forest) constructs the subject
project; and
WHEREAS, Change Order No.8 (Kincaid Forest) would cause the cumulative sum of
change orders to exceed the higher of $50,000 or 25% administrative approval level and thus
requires Town Council approval; and
WHEREAS, all costs for this work will be tracked separately from the Sycolin Road
Widening Phase I-A project for future auditing by the developer and Town staff for determination
of the final "Cash in Lieu of Construction" payment; and
WHEREAS, sufficient funds in the Capital Projects fund are available and no additional
funding is needed; and
WHEREAS, the FY 2008-2012 Capital Improvement Program does not include this
segment of Battlefield Parkway.

ROAD WIDENING PHASE I-A PROJECT, AND AUTHORIZING THE
TOWN MANAGER TO EXECUTE IT
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as
follows:
SECTION 1. The FY 2008-2012 CIP is hereby amended to include construction of
Battlefield Parkway between Tavistock Drive and Kincaid Boulevard.
SECTION I1. Change Order 8 (Kincaid Forest) in the amount of $650,368.50 is hereby
approved.
SECTION III. The Town Manager is hereby authorized to execute this change order.
