HomeMy Public PortalAbout2008_05_13_r071 Fee Waiver for PPEA Application for Loudoun Street Property The Town of Leesburg, Virginia PRESENTED: May 13.2008 RESOLUTION NO. 2008-71 ADOPTED: May 13.2008 A RESOLUTION : WAIVER OF FEE FOR UNSOLICITED PUBLIC PRIV ATE EDUCATION FACILITIES AND INFRASTRUCTURE ACT PROPOSAL FOR LOUDOUN STREET DEVELOPMENT AND DIRECTION TO ACCEPT PROPOSAL FOR FURTHER ANALYSIS WHEREAS, the Town Council is interested in examining a number of options pertaining to the use of Town-owned land on Loudoun Street at the entrance to the Town's parking garage; and WHEREAS, the Town has received an unsolicited proposal from Chapin Holdings, L.L.C., under the Public Private Education Facilities and Infrastructure Act for the construction of a building located at 6-12 Loudoun Street, and WHEREAS, the Town is also examining the land for Downtown park use, and WHEREAS, the Town would like to consider all options available. THEREFORE, RESOLVED by the Council of the Town of Lees burg in Virginia as follows: SECTION I. Pursuant to the Town of Leesburg combined guidelines for the "Public and Private Infrastructure Act of 2002 (PPEA), as revised; Public and Private Infrastructure Act of 1995, as revised (PPTA)"; and adopted by resolution on October 24, 2006 enabling said guidelines, the Town Council hereby waives the fee that is required for an unsolicited proposal pursuant to guideline Section I. (C)(x); "Reservation of Town Rights." SECTION II. Pursuant to the Town of Leesburg combined guidelines for the "Public and Private Infrastructure Act of 2002 (PPEA), as revised; Public Private Infrastructure Act of 1995 -2- A RESOLUTION: WAIVER OF FEE FOR UNSOLICITED PUBLIC PRIV A TE EDUCA nON ACT PROPOSAL FOR LOUDOUN STREET DEVELOPMENT AND DIRECTION TO ACCEPT PROPOSAL FOR FURTHER ANALYSIS (PPTA), as revised;" and adopted by resolution on October 24,2006 enabling said guidelines; the Town Council hereby directs that the Town Manager, pursuant to guideline Section V.(A), "Decision to Accept and Consider Unsolicited Proposal;" to accept the unsolicited proposal from Chapin Holdings, L.L.C., provided that all other requirements for the submission have been complied with to the satisfaction of the Town Manager. The Town Manager, in his discretion, may proceed to Step A (2) of the PPEAlPPT A. PASSED this 13th day of May 2008. C. Umstattd, Mayor Town of Leesburg
