Cole seconded. Unanimous. ITEM #3.1: Rigsbee read the following prepared statement: The criteria for rezoning an area to the + overlay district are met. There is very strong opposition to this request. As the Zoning Ordinance states that some of the purposes of the Ordinance are to "accomplish compatible developmer ...in a manner that will best . . . . .promote desirable living conditions and the stability of neighborhoods; to protect property against blight and depreciation.." and as many residents of the area view the addition of the 3verlay zone will not result in the above purpose, the rezoning of this acre should receive deep thought by the Boards. Page moved to follow the recommendation of the Planning Director and recommend denial of the + overlay district for the reasons stated. Moore seconded. Unanimous. PLANNING DIRECTOR'S ANALYSIS: 2 / 1 /88 The application criteria are not met for t rezoning. 1here is no access onto an arterial road - the access on is a priva road. Sewer service is not provided to this property and there are no plans € its extension at this time. One parcel to the north is zoned GC all other pari are zoned R20. Although, in the future, this could be a viable commercial nod the rezoning of the property at this time would be premature. If the property is to be rezoned GC access through the Laws' lot on Hwy 70 should be obtained:: this 5.4 acre tract. Also,. the maintenance and dedication of Highland Loop Rd should be ascertained and required. Definate sewer extension plans should be in place before this property is rezoned. Page moved to recommend denial with the reasons that the Planning Director stated and that it should be noted that zoning marches with the land and not with the owner. Moore seconded. Vote 8-1 with Culbreth voting no and Ashley not in attendence. February 4, 1988 Page 2 ITEM #3.3 The Board discussed the compact car requirements. Rigsbee asked to amend the proposed ordinance amendment by adding that "compact car spaces be clearly designated" at the end of the paragraph and that the word "customer" should be added before references to entrances. Ashley moved to leave the Parking Section as presented except for Rigsbee's two amendments above. Cole seconded. In discussion, Page noted that the 40% allowance for compact cars could be lessened to 30% and the Board concurred. Ashley and Cole amended their motion and second to reduce the percent of compact cars in the secondary area to 30".. Unanimous. ITEM #3.4: After discussion the Board concurred to add the wording "and fences not exceeding 6 feet in height at the end of the sentence and to eliminate the word "fence" as stated earlier in the paragraph. Page moved to recommend adoption of the buffer standards as amended. Moore seconded. Unanimous. ITEM #3.5, The�Park Plan was amended by adding the Town lot at Occoneechee, #3.� King & Margaret Sts. #3.7 Culbreth thanked Rigsbee for her work in the preparation of the Subdivision Regulations. Davis moved to recommend approval of the Subdivision Regulations, the Park Plan and the Street Classification Plan. Cole seconded. Unanimous. ADDITONS: The 1988-89 budget will be discussed at the next meeting. Page reported on the Water Meeting in Chapel Hill. John Wray pre- sented the Capacity Use Plan, John Hartwell presented the Dam Site. Page reported on the Hillsborough Commons project and said that the main problem was making Mayo St. more useable to the public and that the Board of Adjustment asked for left turn and deceleration lanes. Rose and Rigsbee reported on the Capacity Use Study Public Hearing and that users of water over 100,000 gallons per day would have to obtain permits from the State. Rigsbee said the Mayor presented a 5 part plan for water management but most of the public speakers were for the Capacity Use designation. Ja et T. Rigsb ecretary
