A RESOLUTION: A WARDING THE WATERLINE AND SANITARY SEWER ON-CALL
CONSTRUCTION CONTRACT
RESOLUTION NO. 2008-76
WHEREAS, the Waterline and Sanitary Sewer On-Call construction project is funded
through various Capital Improvement Program (CIP) projects in FY 2008 and the recently
approved FY 2009-13 CIP; and
WHEREAS, in response to a public solicitation for the construction bids of the Waterline
and Sanitary Sewer On-Call Construction project, the Town received bids on May 2, 2008, from
the following firms:
. Tessa Construction & Tech Company, LLC
$2,300,000.00
. Mid Atlantic Site Development, Inc.
$4,688,023.44; and
WHEREAS, the bids were evaluated by the Director of the Department of Capital Projects
Management and the Chief Purchasing Officer in accordance with the Town's Purchasing Policy;
and
WHEREAS, Tessa Construction & Tech Company, LLC was determined to be the lowest
responsive and responsible bidder; and
WHEREAS, the second bidder was determined to be non-responsive due to not providing
the required Bid Bond; and
WHEREAS, this is a unit price contract and the quantities used for bid comparison are
estimates; and
WHEREAS, the locations to be completed by this contract will be largely determined by
the current CIP and the recently approved FY 2009-13 CIP; and

WHEREAS, the work will be assigned to the contractor on a task order basis; and
WHEREAS, the total dollar amount spent on this contract in anyone year will vary and
will depend on the budgeted amount for that fiscal year; and
WHEREAS, this is a renewable contract for up to four additional one-year periods.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
Tessa Construction & Tech Company, LLC, in the amount of $2,300,000 for the construction of
this project.
