HomeMy Public PortalAbout2008_05_28_R080 Initiating Amendment to the ZO Set Time Limit for BAR Action The Town of Leesburg, Virginia PRESENTED May 28, 2008 ADOPTED May 28, 2008 A RESOLUTION: AUTHORIZING THE TOWN ATTORNEY TO ADVERTISE PUBLIC HEARINGS TO AMEND SECTIONS 3.10, 3.11 AND 7.6 OF THE LEESBURG ZONING ORDINANCE AND TO AMEND THE ZONING ORDINANCE TO SET A TIME LIMIT A TION FOR THE RA.R. TO ACT UPON AN APPLICATION TO OBTAIN A CERTIFICATE OF APPROPRIATENESS RESOLUTION NO.: 2008-80 WHEREAS, Section 3.10, Section 3.11 and Section 7.6 of the Leesburg Zoning Ordinance address the process by which an applicant can appeal the decision of the Board of Architectural Review to the Town Council; and WHEREAS, the Town Council finds it necessary to clarify the appeal review criteria; and WHEREAS, the Town Council finds it necessary to require the B.A.R. to act upon applications that come before the Board for a certificate of appropriateness in a time certain; and WHEREAS, the Leesburg Planning Commission must schedule a public hearing and forward recommendation to the Town Council. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the Town Attorney is authorized to advertise a public hearing of the Planning Commission to be held June 19,2008 and a public hearing of the Town Council to be held June 24,2008 to amend Sections 3.10, 3.11, and 7.6 of the Leesburg Zoning Ordinance.
