A RESOLUTION: AWARDING THE TOWN-WIDE TREE PLANTING RENEWABLE
CONTRACT
WHEREAS, the Town-wide Tree Canopy project is a funded Capital Improvement
Program (CIP) project; and
WHEREAS, in response to a public solicitation for the construction bids of the Town-wide
Tree Planting Renewable Contract, the Town received bids on June 2, 2008, from the following
firms:
. Environmental Quality Resources, LLC
$161,989.00
. White Oaks Nurseries, Inc.
$208,437.74
. Dominion Nursery
$222,976.80; and
WHEREAS, the bids were evaluated by the Director of the Department of Capital Projects
Management and the Chief Purchasing Officer in accordance with the Town's Purchasing Policy;
and
WHEREAS, Environmental Quality Resources, LLC was determined to be the lowest
responsive and responsible bidder; and
WHEREAS, the third bidder was determined to be non-responsive due to not providing the
required Bid Bond; and
WHEREAS, this is a unit price contract and the quantities used for bid comparison are
estimates; and

WHEREAS, the locations to be completed by this contract will be largely determined by
the current CIP and the recently approved FY 2009-13 CIP; and
WHEREAS, the initial planting efforts will be on Battlefield Parkway between Smarts
Lane and Tennessee Drive; and
WHEREAS, the work will be assigned to the contractor on a task order basis; and
WHEREAS, the total dollar amount spent on this contract in anyone year will vary and
will depend on the budgeted amount for that fiscal year; and
WHEREAS, this is a renewable contract for up to four additional one-year periods.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attomey, with
Environmental Quality Resources, LLC, in the amount of$161,989.00 for the construction of this
project.
