CITY OF TIFFIN IOWA RESOLUTION NO. 2004- 2
A RESOLUTION ACCEPTING THE PRELIMINARY PLAT OF' BIGELOW
SUBDIVISION, A SUBDIVISION TO TIFFIN, JOHNSON COUNTY, IOWA
AND AUTHORIZING THE ENTERING INTO OF THE SUBDIVIDER'S
AGREEMENT
WHEREAS, the Estate of A. Yvonne Bigelow, Executor, Lisa M. Novak, Diana J.
Bigelow, and Nancy A. Bigelow, hereinafter jointly known as "Subdivider/Owner" has filed
with the City a preliminary plat for Bigelow Subdivision, a subdivision to the Town of Tiffin;
and
WHEREAS, the Tiffin Planning and Zoning Commission has reviewed the same
and recommended approval'of the preliminary plat to the council, stating that the current
zoning for all lots is A-1, Agricultural. The Planning and Zoning Commission does
acknowledge that the preliminary plat indicates a proposed rezoning for Lot 2; however, the
Subdivider/Owner will need to apply for rezoning of those lot; and
WHEREAS, the City and the Subdivider/Owner of Bigelow Subdivision, Tiffin;
have agreed to certain terms concerning the subdivision and reduced them to writing in the
"Subdivider's Agreement", as attached hereto and incorporated herein;
WHEREAS, City Attorney, Stephen N. Greenleaf, has given his approval of the
preliminary plat and Subdivider's Agreement; and
WHEREAS, City Engineer, Michael W. Hart, has given his approval of said
preliminary.plat and Subdivider's Agreement; provided however, that no improvements shall
be constructed or installed without the written approval of the City Engineer and when all
necessary permits have been issued from the state and federal agencies.
WHEREAS, the City desires to signify its approval of said preliminary plat of said
subdivision and authorize the installation of improvements.
NOW, THEREFORE, BE IT RESOLVED, by the City Council Tiffin, Iowa, that
said preliminary plat is hereby approved; and further that the developer will need to apply to
rezone Lot 2, to Residential, but until that`rezoning is approved, the entire subdivision shall
be zoned A-1, Agricultural; and
FURTHER, that the Mayor and Clerk are hereby authorized to execute said
Subdivider's Agreement as approved by the City Engineer and City Attorney; and the
Subdivider/Owner agrees to record in Johnson County, this Resolution with the attached
Subdivider's Agreement and provide copies of the recorded documents to the Tiffin City
Attorney.

ON THE 14th day orfJanuary 2004, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Petersen introduced A RESOLUTION ACCEPTING THE
PRELIMINARY PLAT OF .BIGELOW SUBDIVISION, A SUBDIVISION ' TO
TIFFIN, JOHNSON COUNTY, IOWA AND AUTHORIZING THE ENTERING
INTO OF THE SUBDIVIDER'S AGREEMENT, and made a motion for approval.
The motion was seconded by Councilperson —Bar tels
Ayes: Gericke, Dils, Huedepohl, Bartels and Petersen
Nays:_ None.
Motion carried.
WHEREUPON, the Mayor declared that the RESOLUTION ACCEPTING THE
PRELIMINARY PLAT OF BIGELOW SUBDIVISION, A SUBDIVISION TO
TIFFIN, JOHNSON COUNTY, IOWA AND AUTHORIZING THE ENTERING
INTO OF THE SUBDIVIDER'S AGREEMENT, be adopted and signified his
approval of the same by affixing his signature thereto.
PASSED, by the Council on the 14,h day of January 2004, and approved by the Mayor on
the 14th day of January 2004.
