A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0009, LOUDOUN
BAPTIST TEMPLE LOCATED AT 412 EDWARDS FERRY ROAD,
NE., TO PERMIT THE EXPANSION OF AN EXISTING PLACE OF
WORSHIP USE
WHEREAS, The Loudoun Baptist Temple Trustees have requested special exception
approval to permit expansion of the existing place of worship use at 412 Edwards Ferry Road,
NE; and
WHEREAS, the property is located in the R-6 Moderate Density Residential Zoning
District; and
WHEREAS, on May 15, 2008 the Planning Commission recommended conditional
approval ofTLSE-2007-0009 by a vote of6-1; and
WHEREAS, on June 24, 2008 the Town Council held a duly advertised public hearing;
and
WHEREAS, the proposed use meets the special exception standards for a place of
worship as set forth in the Zoning Ordinance; and
WHEREAS, staff recommends conditional approval of this request with the conditions
set forth below; and
WHEREAS, The Council has concluded that the approval of the application would be in
the public interest and in accordance with sound zoning and planning principles.
THEREFORE, RESOLVED that the Council of the Town of Leesburg in Virginia hereby
approves Special Exception TLSE- 2007-0009, Loudoun Baptist Temple, 412 Edwards Ferry
Road, NE, identified in the Loudoun County Land Records as Parcel Identification Numbers

188-35-5928, 188-35-6128, 188-35-6628, 188-35-7145, and 188-35-7140 subject to the
following conditions:
1. Substantial Conformance: Development of this special exception use shall be in
substantial conformance with the Special Exception Plat titled "Plat of Special Exception
Loudoun Baptist Temple" dated 1/30/07 as revised through 4/18/08, and prepared by
Zicht and Associates, PLC. This plat includes Sheets 1 of 9 (Cover); Sheet 2 of 9 (Notes
and Tables); Sheet 3 of9 (Existing Conditions); Sheet 4 of9 (Special Exception Plan);
Sheet 5 of9 (Concept Landscape Plan); Sheet 6 of9 (Concept Lighting Plan); Sheet 7 of
9 (Architectural Renderings); Sheet 8 of9 (Architectural Renderings); and Sheet 9 of9
(Building Illustrations, dated 5/7/08).
2. No Expressed or Implied Waivers: Approval of the special exception does not express
or imply any waiver or modification of the requirements set forth in the Subdivision and
Land Development Regulations, the Zoning Ordinance, or the Design and Construction
Standards Manual (DCSM) except as specifically approved by Town Council or as
shown as approved by Town Council on the Special Exception Plat and supporting
documents.
3. Parking: Prior to site plan approval the applicant must demonstrate through appropriate
legal instruments the permanent availability of off-street parking in a private or public
parking lot within 500 feet of the place of worship per TLZO Section 11.4.2. Shared
Parking (Joint Use) and TLZO Section 11.3. Number of Parking Spaces Required.
4. Walnut Tree: Per the direction of the Urban Forester the 27 inch diameter Black Walnut
tree located at the rear of 108 Prince Street must be protected from construction damage.
Appropriate tree preservation measures shall be approved by the Land Development
Official prior to site plan approval. Appropriate landscape materials may be planted in
any area under the drip line of the tree subject to approval of the Urban Forester.
5. Wooden Fence: Applicant shall provide a six-foot tall wooden fence modeled after the
wooden fence on the Jones property (PIN 188-35-5449) with brick pillars on fifty-foot
centers and a minimum 10-foot wide buffer yard along the entire western and northern
boundaries except for: (a) The first 50 feet from Catoctin Circle along the northern
boundary adjacent to property identified by PIN 188-35-7049 where a four-foot tall
wooden fence may be constructed, and (b) Any locations where masonry fences are
provided per other conditions.
6. Screen Fence: The applicant shall construct a three-foot tall screen fence of similar
design and character to the fence with pillars along the Packard property along the entire
parking lot frontage on Edwards Ferry Road to maintain and continue the vernacular

design of the Edwards Ferry Road corridor and screen the parking lot west of the church
expansion along the Edwards Ferry frontage. A gap may be provided at the foot of said
fence to allow overland flow of runoff and floodwaters.
7. Frontage Improvements: Prior to site plan approval the applicant shall design and
construct all required frontage improvements consistent with the final Lowenbach Capital
Improvement Project (CIP), to include but not be limited to, curb/gutter and related storm
sewer, sidewalk, streetlights and street trees along the Edwards Ferry Road and Catoctin
Circle frontages of the subject property. If the Town's CIP project has been constructed
or if the project has been awarded for construction prior to approval of the applicant's site
plan, the applicant shall incorporate all ofCIP's "approved" improvements into their site
plan (labeled as "constructed by others") and the applicant will not be required to pay for
these frontage improvements.
8. Dedications and Easements: In the event that the applicant decides to wait to make
improvements until after the Lowenbach CIP has been approved and awarded, the
applicant shall agree to provide to the Town at no cost, any and all rights of way as well
as all temporary and permanent easements that may be needed on this site as depicted on
the current version of construction plans for the Catoctin Circle Capital Improvement
Project (CIP), or as modified with the final CIP construction drawings so long as those
modifications do not conflict with the improvements shown on the Loudoun Baptist
Temple special exception plat, including but not limited to, temporary construction
easements, storm drainage easements, sidewalk easements (to contain the sidewalk along
Edwards Ferry Road) and traffic signal easements.
9. BLA Required: Prior to site plan approval a plat of consolidation that combines parcel
numbers PIN 188-35-5928, 188-35-6128, 188-35-6628, 188-35-7330, 188-35-7140 and
188-35-7145 into a single lot shall be approved and recorded.
10. Elevations: The design intent is to reflect and blend in with the residential character of
the Lowenbach neighborhood. Architectural features and details will be employed to
break up the mass and reduce the visual scale of the Church. Toward this end, there will
be a combination of gable and hip asphalt shingle roofs, with projections and features to
reduce the visual extent. The scale of the fayade will be reduced through articulation and
employment of a combination of sidings. At least 20% of the siding on the additions shall
be brick, which will also be used as a design feature delineating gables and other features.
The remainder of the siding shall be wood, composite (concrete hardiplank or similar
material), and/or synthetic stucco. Vinyl and metal shall be limited to details and shall not
be used for basic siding. Windows throughout the additions and the existing building
shall be consistent and complementary, similar in style and character to those in the upper
story of the existing building (though these may be replaced with modern insulated
windows) in that the extent of glazing will be reduced through mullions or other dividers.

All material colors shall be complementary and be general earth tones. The design shall
be generally consistent with the elevations depicted on the drawings and the perspectives
of Phases 1 and 2 (Sheet 9 of 9 Building Illustrations dated 05/07/08 by Zicht
Engineering), which generally depict the maximum allowable massing.
11. Brick Wall: An eight foot tall brick wall shall be constructed along the property
boundary with Lawrence Kelly (PIN 188-35-5527). The wall height may be stepped
down as it approaches Edwards Ferry Road by an amount and at a location to be
determined jointly by the Town and the adjacent property owner prior to site plan
approval. The wall will contain drainpipes positioned as needed to allow surface
drainage to pass through. The adjacent property owner shall be contacted prior to
construction of the wall to finalize details. Landscaping along this property boundary
shall consist of a solid screen of Green Giant Arborvitae or similar evergreens to be
determined by the Town and the adjoining property owner prior to site plan approval.
The evergreens shall be a minimum of six feet (6') tall at the time of planting.
12. Parking Lot Limitations: No recreational equipment or activities shall be permitted on
that portion of the parking facility on property currently known as 406 Edwards Ferry
Road (PIN 188-35-5928). In addition:
a. No permanent storage of vehicles or materials will be permitted in this area;
b. No parking of buses, trucks or commercial vehicles, other than those vehicles
used by parishioners attending church functions, will be permitted in this area;
and
c. The landscape screening on the traffic island between the entrances will be
planted in similar fashion to the shared property line.
13. Construction Noise: Construction activities related to the improvements shown on the
special exception plan shall not commence before 7:00 am on weekdays and 8:00 am on
weekends.
