ITEM #3: Rezoning requests #R83 and #R84 of Warren Summey and Lorene
Turner (adjacent property owners) to rezone 2 lots onthe
south side of Hwy 70 from R-20 to GC (General Commercal).

ITEM #4: Consideration of a complaint by Daniel Wagner on conditions
on the Rex Drive area. Please visit if possible.

PLANNING BOARD
APRIL 7, 1988

ITEM #1: Davis moved to approve the minutes of the March'.3, 1988 meeting.
Cole seconded.
Unanimous.
ITEM #2: Rigsbee announced that there will be a NCAPA Conference at the
Institiute of Government on April 14 & 15 and there is no.charge
for Board members to attend.
Page added the Site Plan Reviews of Hillsborough Commercenter
and Kaye Products.
Item #6 was deleted as Culbreth was not in attendance and was
leading the Land Use project.
ITEM #3: Rigsbee presented the rezoning request by Warren Summey to rezone
a 2.03 acre lot from R-20 to GC. And the rezoning request of
Lorene Turner to rezone a 0.62 acre lot from R-20 to GC. These
two lots are adjacent and are on the south side of Hwy 70.
Rigsbee read from her prepared review as shown in the agenda,
There were no additional comments.
ITEM #4: Daniel and Barbara Wagner came before the Board to complain of
problems on Rex Dr. where they live. Rigsbee stated that the
area is in the extraterritorial zoning jurisdiction but is not
within the corporate limits so only the provisions of the Zoning
Ordinance would apply.
The Wagners said that there was junk everywhere and that it
attracts rats. They said that there was an illegal school bus on
the lot that has had a shed built around it. There is an
addition on the back of the second trailer at the mobile home
park and it was said that this could not be occupied but at the
present time two families are living in it. Also Herbert Keeter
did not underpin his double wide mobile home. Also, Bob Caddell
has junk cars on his lot and there is other junk around. Also,
there is junk and trash on the Kennedy rental lot and on the
Freeland vacant lot.
Mr. Wagner has gone to the county and is trying to get an anti -
junk ordinance. The county did bring a dump truck out for the
residents to use one Saturday but there is still junk around.
Davis agreed that rats were a problem throughout Town.
Rose suggested that a letter be written to the Town Board, that
Don Powell, Orange County Planning, and Tony Laws, Orange County

The Board's consensus was that this matter should go before
the Town Board in the form of a letter drafted by the Planning
Board.
Rigsbee explained the clarification and minor revisions that
she had written for section 5.11 (Stream Buffers) which was
included in the agenda.
Rose explained that the floodway shown on the prepared map
is that area in which there is fast movement of water during a
100 year storm and that the floodplain as shown on the map is
the area that becomes flooded during a 100 year storm.
Page asked if the floodplain is shown on the survey or deed when
a lot is purchased. Hogue (a local attorney) said that if there
is a loan involved, that the bank will require floodplain certifi-
cation but if the land is purchased with cash that it could be
missed.
Hogue who said that his house is easily within 50 feet of the
floodway said that if the floodway is filled in,that the
stream will not rise. He suggested that the Board consider that
the roots of the vegetation can't be disturbed which would allow
for taming of the area or require that a ground cover be installed.
He asked for the Board to consider that the buffer be added to
the river rather than to the edge of the floodplain.
Murphy asked if the horse barn built by James J. Freeland and
which is located in the floodplain had received a permit. Rigsbee
said no that a Stop Work Order had been placed on it but no further
action had been taken.
Murphy suggested that an expert opinion be sought and Ed Holland
from Triangle J was agreed upon.
Rose said that it seemed that a normal buffer is located in the
floodplain area or is a small buffer. He said that in Carrboro
the buffer is 60' from the floodway and that in Durham building
is allowed in the floodplain if the Flood Plain Ordiannce is met.
Page moved to ask for Ed Holland's advise on the stream buffer.
Evans seconded.
Unanimous.
Rigsbee reviewed the notification requirement changes as shown
in the agenda. The Board had no questions.
ITEM #5C: Rigsbee stated that she did not know the wishes of the Board as
to how to rewrite the Underground Utilites section of the
ordinance. Rose said that he will meet with Steve: Cruise from
Duke Power and perhaps this could go to the July Public Hearing.
D. Cates will get Durham's ordinance regarding utilities.
ADDITION: Page described the Hillsborough Commercenter and Kaye Products
