HomeMy Public PortalAbout2008_07_22_R113 The Town of Leesburg, Virginia RESOLUTION NO.: 2008-113 PRESENTED July 22. 2008 ADOPTED July 22. 2008 A RESOLUTION: APPROVING THE BOUNDARY LINE ADmSTMENT BETWEEN THE COUNTY OF LOUDOUN, VIRGINIA, AND THE TOWN OF LEESBURG, VIRGINIA (VETERAN'S PARK) WHEREAS, Section 15.2-3106 et seq. of the Code of Virginia (1950), as amended, authorizes Virginia counties and towns to change the boundary lines existing between them by agreement in accord with specified statutory procedures contained therein; and WHEREAS, the Town of Leesburg desires to bring 85.6 acres ofland, more or less, owned by the Town, within the limits of the Town, to be used for park and open space purposes; and WHEREAS, the Northern Virginia Regional Park Authority, the owner of a parcel of approximately 223 acres, located to the north of the existing Town limits and lying partly within the Town and partly with Loudoun County, desires to bring the portion of said parcel lying within Loudoun County, 55.5 acres, more or less, within the Town's corporate limits, to be used for park and open space purposes; and WHEREAS, the Council of the Town of Leesburg adopted Resolution No. 2006-191 on November 14,2006, to authorize the Town Manager to commence proceedings with the County of Loudoun to complete a Boundary Line Adjustment to expand the Town's corporate limits to encompass the aforesaid 141.1 acres ofland, more or less, a copy of which Town Resolution is Attachment I to this Resolution; and - 2 - A RESOLUTION: APPROVING THE BOUNDARY LINE ADJUSTMENT BETWEEN THE COUNTY OF LOUDOUN, VIRGINIA, AND THE TOWN OF LEESBURG, VIRGINIA (VETERAN'S PARK) WHEREAS, the Town of Leesburg, following the notice required by Section 15.2-3107 ofthe Code of Virginia (1950), as amended, has conducted a public hearing on the matter on May 13,2008 and July 22,2008, and determined that it is appropriate for said land to be incorporated within the Town's corporate limits for such purposes; and WHEREAS, the Board of supervisors of Loudoun County and the Council of the Town of Leesburg concur that the existing boundary line between the County of Loudoun and the Town of Leesburg should be changed in accordance with the Boundary line Adjustment Agreement set forth in Attachment 2 to this Resolution. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The Town of Leesburg hereby approves the Boundary Line Adjustment Agreement as set forth in Attachment 2 to this Resolution. SECTION II. The Attorney for the Town of Leesburg is hereby authorized to act on behalf of the Town of Leesburg to cooperate with the Attorney for the County of Loudoun in the preparation, execution, filing, and recordation of any documents, pleadings, and orders necessary to ensure the entry and recordation of a Court order designating and establishing the new boundary line.
