Consideration of additions to the agenda.
Matters for Public Hearing of May 26, 1988:
ITEM #2A'' Rezoning requests #R83 and #R84 of Warren Summey and
Lorene Turner (adjacent property owners) to rezone
2 lots on the south side of Hwv 70 from R-20 to GC.
ITEM #2B: Amendment to reduce the notification requirements for
Conditional Use Permits and amendments to the zoning map.
ITEM #2C: Amendment proposal of Cyrus Hogue to reduce the stream
buffer requirements (attachments)
ITEM #2D: Amendment to delete Section 5.22 regarding development
on Eno Mountain (attachments)
ITEM #2E: Amendment to revise section 5.19.2.E and section 5.20.2.c
to change the requirement that Fire Chief give approval.

MAY 5, 1988

ITEM #3: Rigsbee read her prepared Review and Recommendations (attached)
to the Board regarding the Rex Dr. complaints.
Rose said that he would talk with Tony Laws.
Daniel Wagner thinks there has been no improvment since 1980 as
a matter of fact he thinks it is worse. Barbara Wagner said that
most of the junk at the Keeter mobile home park is near the
railroad track and you can't see it from the road. She showed
photos.
Ashley recommended that as long as the Rex Dr. matter is already
on the Town Board agenda that Wagner should attend that meeting
and explain the problem. The other members agreed.
ITEM #2A: The Summey rezoning had been explained last meeting but there was
a new piece of information in that the Elizabeth Brady Rd.
Extension as shown on the adopted Thoroughfare Plan cuts across
the northeast corner of the property.
ITEM 2B: The Turner rezoning had been explained last meeting and there were
no comments or questions.
ITEM 2C: Cyrus Hogue explained his proposal for the reduction of the
stream buffers as distributed in the agenda.
Moore asked if the buffer could not be measured from the edge of
the river rather than the middle.
Rose had a Supreme Court handout regarding flood plain legislation
and he said that development can be limited even if the regulation
devalues the property and this does not constitute a taking.
Page said that the Upper Neuse area has been declared a
nutrient -sensitive area and that a buffer is needed to sift out
impurities like fertilizer.
Hervey McIver, a citizen, said that he was in favor of a stream
buffer.
Hogue said that he felt like the Town needs a buffer and he would
rather see a reasonable width buffer than one that impacts hard
on property owners as the current requirement does.

ITEM #2D: Rigsbee reviewed the ordinance amendment to delete the section
5.22 that says that no structure shall exceed the height of the
Eno Mountain ridge. She said that Piedmont Communications made
this request because they want to put a communications tower on
the Cates property on Occoneechee Mountain.
Rose said that the intent of the section was to preserve the
view from Hillsborough. However, he said, that there was already
a fire tower and a microwave relay station on Occoneechee
Mountain.
Ashley wondered if Piedmont Communications had checked to see
if Orange County would allow a communications tower at the
Lookout Tower.
Culbreth said that there would be other ways to accomplish
erecting a tower on the mountain without deleting that section
of the ordinance. For example, the section could say no building
_ a_ -a -Vowed. That way, a structure like a communications tower
could be permitted.
Rose said that Brad Torgan, Orange County Planning, said that
Eno Mountain has been selected as a top priority area to preserve.
ITEM #2E Rigsbee reviewed the amendments to revise the sections of the
& 2F: ordinance regarding Fire Chief approval of plans. Rather the
Fire Chief's recommendation should be sought. No comments.
ITEM #2F: Rigsbee reviewed the addition to the ordinance regarding fire
hydrant standards.
ITEM #4: Rigsbee reviewed the changes that were made to the ordinance
amendment regarding buffers along the interstate. These changes
were made at the Orange County Planning Board's and staff's
request. No comments.
ITEM Culbreth is spearheading the updating of the Hillsborough Land
Use Plan. He said that he would like to divide the project -into
3 phases. The first phase is the descriptive land use phase and
he would like to divide Hillsborough into three sections and
have three Board members ride over each section and describe the
activities on the land. At the second phase the Town Board will
be approached as to future land uses. And the third phase will
involve the updating of the figures and the rewriting of much of
the text.
The members all signed up for areas to conduct a windshield survey
of the Town and Rigsbee will send them each a packet of inoforma-
tion which will include the text from the 1977 Land Use Plan of
the area in which they are surveying.
The Board agreed to meet a 6:30PM before the Joint Public Hearing
to compare notes on the survey and to ask questions regarding the
survey.

REVIEW AND RECOMMENDATIONS OF THE PLANNING DIRECTOR REGARDING THE
PROBLEMS ON REX DRIVE
Daniel Wagner and Barbara Wagner spoke at the April 7, 1988 meeting
of the Planning Board and raised complaints about 5 of their
neighboring property owners. Since the meeting, I have visited the
neighborhood, read the files with past history, and talked with
Don Powell (Orange County Planning) and Tony Laws (Orange County
Health). This is my analysis and recommendations:
LIMITATIONS: Rex Drive is not in the corporate limits. Therefore,
the only ordinance which we can enforce is the Zoning Ordinance.
Orange County does not have a litter control or rat control ordinance.
GENERAL CONCLUSIONS: The rat problem is not unique to this area and
only advise can be given. The litter problem cannot be addressed by
this office. The Mountain View Mobile Home Park has greatly improved
since the 1980's when the violations were first worked on. Junk cars
could be addressed by this office but as of this date, this section of
the ordinance has not been enforced anywhere else in Hillsborough.
SPECIFIC CONCERNS AND RECOMMENDATIONS:
4.39.B.20 Property of Herbert Keeter. Mr. Herbert Keeter was issued
a Zoning Permit for his new mobile home but has not
underpinned it. Write to Mr. Keeter informing him of the
zoning regulations regarding underpinning.
4.39.A.11 Property of Priscilla Keeter. A Zoning Permit was obtained
to convert a school bus into a storage unit and this was
done - no further work needed. A Zoning Permit was obtained
to put a roof on (and by inference to put siding on) the
2nd mobile home in the park. This was done but it appears
that the addition is larger than 10' x 18'. Write to Ms.
Keeter and inform her that a -revision and review is needed
on that permit. As far as Mr. Wagner's complaint regarding
two families living in the mobile home with the addition:
the Zoning Ordinance is vague about the definition of Family
and it appears that the Keeter home #2 may be in compliance.
In the past, the Planning Department has not investigated
the number of persons living in a dwelling unit and I
recommend that I do not start with this family.
4.39.A.7 Property of Priscilla Keeter. There is a camper on this lot
and I was unable to ascertain whether it was being used as
a residence. Recommend that we write to Ms. Keeter and
inform her that a camper may not be used as a residence.
I further recommend that the Rex Drive item be deleted from the Town
Board, May 8th agenda until the proper letters have been written. At
this point the Town Board does not need to become involved.
