A RESOLUTION: A WARDING THE IDA LEE PARK OUTDOOR POOL
CONSTRUCTION CONTRACT
WHEREAS, the Ida Lee Park Outdoor Pool is a funded capital project; and
WHEREAS, in response to a public solicitation for construction bids due July 14, 2008, the
Town received six bids:

. Morgan - Keller, Inc. $6,000,496.40 $6,251,391.40; and
WHEREAS, the bids were evaluated by the Dire.ctor of the Department of Capital Projects
Management and the Chief Purchasing Officer in accordance with the Town's Purchasing Policy
and the Virginia Public Procurement Act (VPP A); and
WHEREAS, March-Westin was determined to be the lowest responsive and responsible
bidder with a base bid of $4,599,432.47; and
WHEREAS, the project included 8 alternates for water features in the pool; and
WHEREAS, after the alternates were evaluated, the low bidder did not change with the
addition of each alternate; and

WHEREAS, March-Westin Company's Base Bid plus all eight alternates is $4,842,642.74;
and
WHEREAS, March-Westin Company's president was contacted to inform them that they
were the lowest bidder and to inform them of the math errors that were found while evaluating
their bid; and
WHEREAS, the math errors consisted of multiplication errors in calculating the pricing for
the site work and an error in adding the two sections of the bid together; and
WHEREAS, the town bid evaluation indicates that the base bid should be $4,599,432.47;
and
WHEREAS, during a conversation with March-Westin Company's president, they
indicated that they had a math error in their bid and that the base bid price they submitted of
$4,878,113.48 was the price that they could do the work for; and
WHEREAS, March-Westin Company was given the opportunity under section 2.2-4330(i)
of the VPP A to withdraw their bid; and
WHEREAS, March- Westin has elected to not withdraw his bid; and
WHEREAS, the intent is to award the construction contract to March-Westin Company in
the base bid amount of $4,599,432.47 plus the eight alternates for a total contract award of
$4,842,642.74; and
WHEREAS, if March-Westin fails to enter into a contract with the town within 10 days
from the Notice of Award, the town will forfeit his bid bond; and

WHEREAS, given the critical nature of this award, if March-Westin fails to enter into a
contract with the town, it is recommended to move immediately to the second place bidder R.E.
Daffan, Inc. of Man ass as, VA in the amount of$5,182,127.50 that includes the alternates; and
WHEREAS, this is a unit price contract where the estimated quantities multiplied by the
unit price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS, sufficient funding is available to award this contract.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia.
Section 1. The Town Manager is authorized to execute a contract, in a form approved by
the Town Attorney, with March-Westin Company, Maryland Division, in the amount of
$4,842,642.74 for the construction of this project.
Section II. If March- Westin Company fails to enter into a contract with the Town in the
required 10 days from Notice of Award, the Town Manager is authorized to execute a contract, in a
form approved by the Town Attorney, with R.E. Daffan, Inc., in the amount of$5,182,127.50 for
the construction of this project.
PASSED this 22nd day of July 2008.
