HomeMy Public PortalAbout2008_09_09_R132 TLSE 2008-0006 Village @Leesburg Parking Deck D The Town of Leesburg, Virginia PRESENTED: September 9.2008 RESOLUTION NO. 2008-132 ADOPTED: September 9. 2008 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2008-0006 VILLAGE AT LEES BURG PARKING DECK D TO ELIMINATE TWO ELEVATED PEDESTRIAN W ALKW AYSIN THE VILLAGE AT LEESBURG DEVELOPMENT WHEREAS, Carlyle/Cypress Leesburg LLC and Springfield East, LC have requested a Special Exception to eliminate two of the four elevated pedestrian walkways approved as part of TLSE-2004-0023 in the B-4 Zoning District in Landbay A of the Village at Leesburg development; and WHEREAS, a duly advertised Planning Commission public hearing was held on August 7,2008; and WHEREAS, at their regular meeting of August 7, 2008 the Planning Commission recommended conditional approval of this application to the Town Council; and WHEREAS, the Town Council held a duly advertised public hearing on this application on September 9, 2008; and WHEREAS, the staff recommends conditional approval; and WHEREAS, the Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: Special Exception application TLSE-2008-0003, Village at Leesburg Parking Deck D is hereby approved with the following conditions: I. Substantial Conformance. Development of this property shall be in substantial conformance with the special exception plan entitled "Special Exception for Parking Deck D", Sheets 1-4, dated 2/15/08, revised 5/13/08 prepared by Bowman Consulting Group, Ltd. ("the Special Exception Plat") with reasonable allowances to be made for -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2008-0006 VILLAGE AT LEES BURG PARKING DECK D TO ELIMINATE TWO ELEVATED PEDESTRIAN W ALKW A YSIN THE VILLAGE AT LEESBURG DEVELOPMENT engineering and design alteration to meet Town Subdivision and Land Development Regulations, Zoning Ordinance or Design and Construction Standards Manual requirements. 2. No Waivers Express or Implied. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans, and construction drawings are subject to the applicable town regulations. 3. Lighting. Site lighting shall be in conformance with DCSM Section 7-670, which states, "All outdoor lighting fixtures exclusive of street lights will not have a source of illumination that is visible beyond the site or cause illumination of adjacent properties in excess of 0.5 foot-candles, as measured at the site boundary." Conformance with the DCSM limitations shall be reviewed as part of Final Development Plan approval. The garage shall be designed to eliminate direct glare from automobile headlights on adjacent residential uses. The applicant shall be responsible for installing light shields on any light fixtures determined to be the source of excessive glare by the Zoning Administrator. 4. Landscaping. The landscape layout shown on the Special Exception Plat is subject to review and approval by the Town at Final Development Plan or No Adverse Impact Plan review. 5. Subiect to H-2 Guidelines. Architectural design shall be made subject to H-2 Corridor Guidelines and subject to the review of the Board of Architectural Review. Architectural elevation drawings that show the architectural design, materials, and colors of the proposed parking structure shall be submitted in accordance with H-2 Corridor Guidelines. 6. Noise Mitigation. Efforts shall be employed by the applicant to minimize excessive noise impacts from the use of the parking structure on adjacent residential uses. 7. Crosswalks. Crosswalks across the alley between Parking Deck D and adjacent buildings to the south shall be textured and not just painted. 8. Site Plan not Modified by Conditions. Conditions 1-7 above shall not be interpreted to modify or amend TLPF 2006-0028, the by-right site plan for the Village Center approved May 28, 2008, or TLHP-2007-0032, the approval by the Board of Architectural Review of a portion of the project. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2008-0006 VILLAGE AT LEES BURG PARKING DECK D TO ELIMINATE TWO ELEVATED PEDESTRIAN W ALKW A YSIN THE VILLAGE AT LEESBURG DEVELOPMENT PASSED this 9th day of September. 2008.
