HomeMy Public PortalAbout2008_09_09_R133 TLSE 2008-0006 Village @Leesburg Personal Services The Town of Leesburg, Virginia PRESENTED: September 9. 2008 RESOLUTION N0.2008-133 ADOPTED: September 9.2008 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2008-0006 VILLAGE AT LEESBURG PERSONAL SERVICES TO PERMIT PERSONAL SERVICE USES IN THE B-4 ZONED PORTION OF THE VILLAGE AT LEESBURG DEVELOPMENT WHEREAS, Carlyle/Cypress Leesburg LLC and Springfield East, LC have requested a Special Exception to permit personal service uses in the commercial areas of the B-4 Zoning District in Landbay A of the Village at Leesburg development; and WHEREAS, a duly advertised Planning Commission public hearing was held on August 7,2008; and WHEREAS, at their regular meeting of August 7, 2008 the Planning Commission recommended conditional approval of this application to the Town Council; and WHEREAS, the Town Council held a duly advertised public hearing on this application on September 9, 2008; and WHEREAS, the staff recommends conditional approval; and WHEREAS, the Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, RESOLVED by the Council ofthe Town of Leesburg in Virginia as follows: Special Exception application TLSE-2008-0006, Village at Leesburg - Personal Services identified in the Loudoun County Land Records as Parcel Identification Number 149- 18-2092-002 is hereby approved with the following conditions: 1. Personal Services. Personal services shall be permitted in the B-4 (Mixed Use Business) Zoning District approved as part of the Village at Leesburg development. No Waivers Express or Implied. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual. Final plats, development plans, and construction drawings are subject to the applicable town regulations. PASSED this 9th day of September. 2008. stattd, Mayor Town of Leesburg
