RESOLUTION NO. 2008-144
A RESOLUTION: A WARDING THE ANNUAL CONTRACT FOR REFUSE AND
RECYCLING COLLECTION SERVICES TO CON-SERVE INDUSTRIES,
INC. IN THE AMOUNT OF $2,456,648.48
WHEREAS, the current contract for Refuse and Recycling Collection expired on June 30,
2008; and
WHEREAS, sealed bids for Refuse and Recycling Collection Services that included (1) one
bid alternate for additional yard waste services were opened on Tuesday, April 29, 2008 at 3:00
p.m.; and
WHEREAS, the bids have been checked, evaluated and recalculated to comply with the unit
price bid documents, the resulting correct bid results are as follows:

WHEREAS, the bids from American Disposal Services, Bates Trucking Company, Inc. and
KMG Hauling, Inc. were determined to be non-responsive; and
WHEREAS, the bid from Con-Serv Industries, Inc. was determined to be the lowest
responsive, responsible bidder; and
WHEREAS, award of this contract was delayed by a bid protest and lawsuit filed by Bates
Trucking Company; and
WHEREAS, the bid protest was found to have no merit and the law suit has been dismissed;

WHEREAS, current refuse and recycling services were continued on a month to month
basis with Con-Serv Industries, Inc. under the terms of the old contract; and
WHEREAS, the terms of the contract provide for an initial (1) one year period, which may
be extended for up to (4) four additional (1) one-year terms; and
WHEREAS, the initial term should be reduced to nine months (October 1, 2008 to June 30,
2009) due to the delay caused by the bid protest and the need to match the contract term to the
Town's fiscal year budget; and
WHEREAS, the FY2009 Budget for Refuse and Recycling has sufficient funds for award of
the base contract plus the (1) one alternate; and
WHEREAS, the Director of Public Works recommends award of the FY2009 Refuse and
Recycling Collection Contract to Con-Serv Industries, Inc.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
The Town Manager is hereby authorized to enter into a contract with Con-Serve Industries,
Inc. to provide Town refuse and recycling collection service for the period of October 1, 2008 to
June 30, 2009 in accordance with the terms of the Invitation for Bid dated March 28,2008, and the
unit prices and total bid of $2,456,648.48 for the base bid plus the (1) one alternate in the Bid
received on April 29, 2008.
