A RESOLUTION:
AUTHORIZING THE MAYOR TO EXECUTE THE THIRD AMENDED
CONTRACT TO PURCHASE RIGHT OF WAY FROM REHAU
WHEREAS, the Town and Rehau, Incorporated entered into a sales contract dated November 20,
1998 for the purchase of right of way required for Battlefield Parkway as authorized by Resolution Number
98-261 dated November 17,1998; and
WHEREAS, Amendment Number 1 to that sales contract was executed on January 29, 1999 and
Amendment Number 2 was executed on June 19,2008 as authorized by Resolution No. 2008-88; and
WHEREAS, more accurate and additional information has subsequently been utilized to determine
the property requirements for Battlefield Parkway; and
WHEREAS, Town staff and Rehau have negotiated the attached Third Amended Sales Contract in
light of the additional information.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows:
SECTION I. The attached Third Amended Sales Contract for Rehau is hereby approved.
SECTION II. The Mayor is authorized to execute the final Third Amended Sales Contract as
approved by the Town Attorney.
