HomeMy Public PortalAbout2008_10_15_R152 TLSE 2007-0003 Market Square @ Potomac Station The Town of Leesburg, Virginia PRESENTED: October 15.2008 RESOLUTION NO. 2008-152 ADOPTED: October 15. 2008 A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0003, MARKET SQUARE AT POTOMAC STATION BANK DRIVE-THROUGH LOCATED ON POTOMAC STATION MIXED-USE PARCEL A ON POTOMAC STATION DRIVE, NE. WHEREAS, Potomac Station Mixed Use, LLC. has requested special exception approval to permit a four-lane drive-through as part of the proposed bank on land bay D of the Market Square at Potomac Station development on Potomac Station Mixed-Use Parcel A on Potomac Station Drive, NE, and WHEREAS, the property is located in the PRC - Planned Residential Community Zoning District; and WHEREAS, on June 19,2008 the Planning Commission recommended conditional approval by a vote of 5-2; and WHEREAS, on September 23, 2008 the Town Council held a public hearing; and WHEREAS, staff recommends denial; and WHEREAS, Town Council has determined the proposed use meets the special exception standards for a bank drive-through facility as set forth in the Zoning Ordinance. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia hereby approves Special Exception application TLSE- 2007-0003, Market Square at Potomac Station Bank Drive-Through, Potomac Station Drive, NE, identified in the Loudoun County Land Records as Parcel Identification Number 148-27-6339, subject to the following conditions: -2- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0003, MARKET SQUARE AT POTOMAC STATION BANK DRIVE-THROUGH LOCATED ON POTOMAC STATION MIXED-USE PARCEL A ON POTOMAC STATION DRIVE, NE. Substantial Conformance: 1. Development of this special exception use shall be in substantial conformance with the Special Exception Plat titled "Market Square at Potomac Station" dated June, 1 2006, revised through October 6, 2008 prepared by Dewberry & Davis, LLC. This plat includes Sheet 1 of 5 (Cover Sheet); Sheet 2 of 5 (Special Exception Plat); Sheet 3 of 5 (Special Exception Plat - Photometric Plan); Sheet 4 of 5 (Bank Elevations) and Sheet 5 of 5 (Screen Wall Elevations). No Expressed or Implied Waivers: 2. Approval of the special exception does not express or imply any waiver or modification of the requirements set forth in the Subdivision and Land Development Regulations, the Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except as specifically approved by Town Councilor as shown as approved by Town Council on the Special Exception Plat and supporting documents. Site Lighting: 3. All lighting fixtures used to illuminate outdoor areas shall be designing to avoid glare to the surrounding areas in accordance with Design and Construction Standards Manual Section 7-670 and Zoning Ordinance Section 12.11. The facility shall be lit only during the hours that the facility is open for business, except for necessary security lighting. Prior to Site Plan approval a lighting plan shall be submitted to verify that all lighting fixtures are directed onto the site, and will not impact adjacent properties or roadways. Speaker Volume: 4. Speakers used in the drive-through shall be directed away from the adjacent single-family dwellings and not emit sound levels in excess of the maximums established in Zoning Ordinance Section 7.9.3. Miscellaneous Site Design: 5. An eight-foot (8') tall masonry screen wall shall be constructed at the top of the retaining wall along the entire length of the retaining wall. 6. A detail shall be provided to the Urban Forester as part of the site plan showing a section and plan view of how the retaining wall and plant material will be installed to verify that the trees shown can indeed be planted as depicted. -3- A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2007-0003, MARKET SQUARE AT POTOMAC STATION BANK DRIVE-THROUGH LOCATED ON POTOMAC STATION MIXED-USE PARCEL A ON POTOMAC STATION DRIVE, NE.
