A RESOLUTION: INITIATING AMENDMENTS TO ARTICLE 14 OF THE LEESBURG
ZONING ORDINANCE TO ESTABLISH APPROPRIATE CRITERIA
TO WAIVE THE CREEK V ALLEY BUFFER SETBACK ALONG
TOWN BRANCH BETWEEN DRY MILL ROAD SOUTHEAST TO
CATOCTIN CIRCLE
WHEREAS, the Town Council adopted amendments to Natural Resource Objective 1 of
the Town Plan on November 12, 2008; and
WHEREAS, Zoning Ordinance Article 14 Creek Valley Buffer lacks any criteria to
waive the buffer setback along Town Branch between Dry Mill Road southeast to Catoctin
Circle in accordance with Objective 1 of the Natural Resources Element of the Town Plan; and
WHEREAS, the proposed amendments will align the Zoning Ordinance with the revised
policy of the Town Plan; and
WHEREAS, these amendments will provide enhanced redevelopment opportunities in
accordance with the Crescent District Master Plan; and
WHEREAS, the proposed amendments are intended to facilitate economic development;
and
WHEREAS, the amendments will provide the necessary criteria to protect water quality
when Creek Valley Buffers are waived.
THEREFORE RESOLVED by the Leesburg Town Council as follows:
SECTION I. Amendments to Zoning Ordinance Article 14 are hereby initiated and
referred to the Planning Commission to establish appropriate Creek Valley Buffer waiver criteria
consistent with the Town Plan; and

SECTION II. The Planning Commission shall hold a public hearing to consider these
amendments to the Zoning Ordinance, and report its recommendation to the Town Council
pursuant to Chapter 22, Title 15.2-2204 ofthe 1950 Code of Virginia, as amended.
