HomeMy Public PortalAboutResolutions-2004-267CITY OF TIFFIN ORDINANCE NO. 2004-267 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIPAL CODE OF TIFFIN, IOWA, FOR CERTAIN PROPERTY LOCATED WITHIN THE CITY LIMITS ALONG IRELAND AVENUE (EXTENSION OF ROBERTS FERRY ROAD) (AS OWNED BY GRACE-BACULIS FARM PARTNERSHIP) BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Putpose. The purpose of this ordinance is to amend the official zoning map of the Municipal Code of Tiffin, Iowa, concerning the following described property to - wit, located in Tiffin, Johnson County, Iowa. Section 2. Amendment. The following legally described property: SE 1/4 NE 1/4; NE 1/4 SE 1/4; except Lot 1 of Milkwood (Plat Book 28, Page 40); SE 1/4 SE 1/4 and South 30 feet of NW 1/4 SE 1/4 of Section 21-80-07 SW 1/4 NW 1/4 of Section 22-80-07 NE 'ANE 1/4 ; NW 1/4 NE 1/4; and NE 1/4 NW 1/4 lying East of Robert's Ferry Road (formerly known as Rollo Johnson Road, Irish Avenue and James Avenue) of Section 28-80-07 EXCEPT part of Lot 2 Gracehill Estates (Plat Book 44, Page 135) and EXCEPT part of Auditor's Parcel 2000 028 (Plat Book 41•— Page 194) shall be changed from zoning classification from A-1, Agricultural .to R-1, Single Family Residential, and further, that the official zoning map of the City be amended to reflect the change described herein. Section 3. Penalty Provision. The city may elect, at its sole discretion, to prosecution any violation either as simple misdemeanor or a municipal infraction. Section 4. Re ealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision, or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. The motion was seconded by Councilperson Huedepohl Ayes: Huedepohl, Bartels, and Dils. Nayes: None. Absent: Petersen and Gericke. Th -r— 2 members of the council being present and having voted "Aye", Mayor Glen R. Potter declared the motion carried, and Ordinance No. 2004-267, was read the first time and discussed and placed on record. On the 9th day of June 2004, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Gericke introduced Ordinance No. 2004-267, and moved that it be given its second reading. The motion was seconded by Councilperson Huedepohl. Whereupon Mayor Glenn R. Potter read the ordinance the second time by title only. Ayes: Gericke, Bartels, Dils, Huedepohl. Nayes: Motion carried. Thereupon it was moved by Councilperson Bartels and seconded by Councilperson Dils to read ORDINANCE NO. 2004-267 entitled AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIPAL CODE OF TIFFIN, IOWA, FOR CERTAIN PROPERTY LOCATED WITHIN THE CITY LIMITS ALONG IRELAND AVENUE (EXTENSION OF ROBERTS FERRY ROAD) (AS OWNED BY GRACE- BACULIS FARM PARTNERSHIP), a third time and that the rules requiring a second and third reading and reading on three separate dates be dispensed with and the ORDINANCE NO. 2004-267 was placed upon record. Ayes: Gericke, Dils, Bartels and Huedepohl Nayes: None. Absent: Petersen. Motion carried. Councilmember Dils moved and Huedepohl seconded that ORDINANCE NO. 2004-267 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIPAL CODE OF TIFFIN, IOWA, FOR CERTAIN PROPERTY LOCATED WITHIN THE CITY LIMITS ALONG IRELAND AVENUE (EXTENSION OF ROBERTS FERRY ROAD) (AS OWNED BY GRACE-BACULIS FARM PARTNERSHIP), having been read and placed on record be finally placed upon its final passage and adopted. Roll Call: Ayes: Gericke, Dils, Bartels, and Huedepohl. Nays: None Absent: Petersen Motion carried. Potter declared the motion carried, and Ordinance No. 2004-267, was passed and adopted and the Mayor signified his approval by fixing his signature thereto. REIHMAN, City Clerk I, Clerk of the City of Tiffin, Iowa, state that an ordinance entitled AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE MUNICIPAL CODE OF TIFFIN, IOWA, FOR CERTAIN PROPERTY LOCATED WITHIN THE CITY LIMITS ALONG IRELAND AVENUE (EXTENSION OF ROBERTS FERRY ROAD) (AS OWNED BY GRACE-BACULIS FARM PARTNERSHIP) and known as No. 2004-267 was duly passed by the council on the 9THday of June 2004, and signed by the Mayor on the 9`h day of June 2004, and published on the day of 200 by posting copies thereof in three public places within the limits of the City of Tiffin, Iowa.
