A RESOLUTION: A WARDING THE N. KING STREET DRAINAGE IMPROVEMENTS
PROJECT CONSTRUCTION CONTRACT
WHEREAS, the N King Street Drainage Improvements project is a funded capital project;
and
WHEREAS, in response to a public solicitation for construction bids of the N. King Street
Drainage Improvements project, the Town received nine bids on November 12,2008, from the
following firms:

$1,387,000.00
. R.L. Rider & Company
$1,414,255.00
. A&M Concrete Corporation
$1,426,908.00
. E.E. Lyons Construction Co., Inc.
$1,486,173.00
. Wm. B. Hopke Co., Inc.
$1,495,320.75
. Omni Excavators, Inc.
$1,556,779.50
. Jeffrey Stack, Inc.
$1,561,151.00
. Sagres Construction, Corp.
$1,653,917.00
. Heritage Contracting of WV, LLC
$1,752,078.80; and
WHEREAS, the bids were evaluated by the Assistant Director of the Department of Capital
Projects Management and the Chief Purchasing Officer in accordance with the Town's Purchasing
Policy; and

PROJECT CONSTRUCTION CONTRACT
WHEREAS, Tessa Construction & Tech Company, LLC was determined to be the lowest
responsive and responsible bidder; and
WHEREAS, this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS, no additional funding is needed to award this contract.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
Tessa Construction & Tech Company, LLC in the amount of$1,387,000.00 for the construction of
this project.
