CITY OF TIFFIN,IOWA RESOLUTION NO. 2003- 47
A RESOLUTION AUTHORIZING THE MAYOR AND CLERK TO
EXECUTE THE EASEMENT AGREEMENT WITH ROGER
UTSLER AND DONNA M. WILLIAMS-UTSLER AND THE
EASEMENT AGREEMENT WITH GREG APEL, LYNN APEL,
J. THOMAS LAWRENCE, SANDRA A. LAWRENCE, CHARLES D.
SWENKA AND MAGINA F. SWENKA FOR THE USE OF CERTAIN
PROPERTY FOR UNDERGROUND UTILITY SERVICES
WHEREAS, Roger Utsler and Donna M. Williams, NKA, Donda M. Williams-
Utsler, husband and wife, are the owners of certain property in and around Tiffin, Iowa;
AND WHEREAS, Greg Apel, Lynn Apel, J. Thomas Lawrence, Sandra A.
Lawrence, Charles D. Swenka and Magina F. Swenka, are the owners of certain property in
and around Tiffin, Iowa;
WHEREAS, the Cit} desires an easement upon a portion of each of the properties
owned by the above-named for the placement of underground utility services, such as storm
sewer;
WHEREAS, the above parties each have agreed to certain terms and conditions and
reduced them to writing and both are known as the "Utility Easement Agreement", the same
are attached hereto and incorporated herein.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Tiffin, Iowa, that
the Mayor and Clerk shall execute two "Utility Easement Agreement", as attached hereto,
and the City shall comply with all terms and conditions set forth therein.
ON THE 17th day of December 2003, at a special meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Df Is introduced, A RESOLUTION

SERVICES, and made a motion for approval. The motion was seconded by
Councilperson PPP -4.1 Dp6L

Motion carried.
WHEREUPON, the Mayor declared that the A RESOLUTION AUTHORIZING
THE MAYOR AND CLERK TO EXECUTE THE EASEMENT
AGREEMENT WITH ROGER UTSLER AND DONNA M. WILLIAMS-
UTSLER AND THE EASEMENT AGREEMENT WITH GREG APEL,
LYNN APEL, J. THOMAS LAWRENCE, SANDRA A. LAWRENCE,
CHARLES D. SWENKA AND MAGINA F. SWENKA FOR THE USE OF
CERTAIN PROPERTY FOR UNDERGROUND UTILITY SERVICES, be
adopted and signified his approval of the same by affixing his signature thereto.
PASSED, by the Council on the 17th day of December 2003, and approved by the Mayor
on the 17th day of December 2003.
