A RESOLUTION: A WARDING THE DRY MILL/WAGE/ANNE DRAINAGE
IMPROVEMENTS PROJECT CONSTRUCTION CONTRACT
WHEREAS, the Dry Mill/Wage/Anne Drainage Improvements project is an approved
capital project; and
WHEREAS, in response to a public solicitation for construction bids of the Dry Mill/
Wage/Anne Drainage Improvements project, the Town received ten bids on November 24,2008,
from the following firms:

· E.E. Lyons Construction Co., Inc.
. William A. Hazel, Inc.
. Ardent Company, LLC
. General Excavation, Inc.
· Tessa Construction & Tech Company, LLC
. A&M Concrete Corporation
. Jeffrey Stack, Inc.
. William B. Hopke Co., Inc.
· Madigan Construction, Inc. (Non-Responsive)

WHEREAS, the bids were evaluated by the Assistant Director of the Department of Capital
Projects Management and the Chief Purchasing Officer in accordance with the Town's Purchasing
Policy; and
WHEREAS, R.L. Rider & Company was determined to be the lowest responsive and
responsible bidder; and
WHEREAS, the original low bidder, Madigan Construction, Inc. was determined to be
non-responsive due to not completely filling out the bid form and for placing conditions on the bid
prices submitted; and

PROJECT CONSTRUCTION CONTRACT
WHEREAS, this is a unit price contract and the estimated quantities multiplied by the unit
price have established the not to exceed contract price; and
WHEREAS, change order procedures are detailed in the bid specifications; and
WHEREAS, funds in the amount of $480,000 are currently available in the FY 2009 CIP;
and
WHEREAS, an additional $564,640 is needed to award this contract; and
WHEREAS, the additional funding is available from other projects within the Capital
Improvement Fund; and
WHEREAS, the Governors Drive project that was recently cancelled has $150,000
available; and
WHEREAS, the Lowenbach project has been phased and has $414,640 available in FY
2009 to complete the funding for this project.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Town Manager is authorized to execute a contract, in a form approved by the Town Attorney, with
RL. Rider & Company, LLC in the amount of $1,044,640.00 for the construction of this project.
