Home My Public Portal About2008_12_09_R192 Initiating Amendments to Protect Tree Canopy The Town of Leesburg, Virginia PRESENTED December 9.2008 RESOLUTION NO.: 2008-192 ADOPTED December 9. 2008 A RESOLUTION: INITIATING AMENDMENTS TO THE LEESBURG TOWN CODE, ZONING ORDINANCE AND THE DESIGN AND CONSTRUCTION STANDARDS MANUAL TO ESTABLISH TREE ORDINANCES TO FURTHER PROTECT, ENHANCE AND MAINTAIN THE TOWN'S TREE CANOPY WHEREAS, the 2005 Town Plan Natural Resources Element Objective 4 seeks to "preserve, protect and restore the tree canopy within the developed parts of Leesburg and its Urban Growth Area/Joint Land Management Area"; and WHEREAS, the 1950 Code of Virginia Sec. 15.2.9-961.1 authorizes localities to protect existing trees during development and establishes mechanisms to create and maintain a permanent tree canopy; and WHEREAS, the Leesburg Town Code, the Zoning Ordinance and the Design and Construction Standards Manual should be revised as appropriate to establish tree ordinances that incorporate the opportunities provided in the 1950 Code of Virginia, as amended, to further protect, enhance and maintain the tree canopy; and WHEREAS, the public necessity, convenience, general welfare and good zoning practice require the proposed amendments. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. Amendments to the Town Code, the Zoning Ordinance and the Design and Construction Standards Manual as applicable are hereby initiated and referred to the Planning -2- RESOLUTION: INITIATING AMENDMENTS TO THE TOWN CODE, ZONING ORDINANCE AND DESIGN AND CONSTRUCTION STANDARDS MANUAL Commission to establish appropriate regulations for the preservation, enhancement and maintenance of tree canopy within the Town of Leesburg as permitted by the 1950 Code of Virginia, as amended. SECTION II. The Planning Commission shall hold a public hearing to consider these amendments to the Town Code, Zoning Ordinance, and Design and Construction Standards Manual and report its recommendations to the Town Council pursuant to Chapter 22, Title 15.2- 2204 of the 1950 Code of Virginia, as amended.
