A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2008-0010 SPRING
ARBOR TO PERMIT AN ASSISTED LIVING RESIDENCE IN THE
PLANNED RESIDENTIAL NEIGHBORHOOD DISTRICT
WHEREAS, HHHunt Corporation has requested a Special Exception to permit an 87-bed
assisted living residence in the PRN, Planned residential Neighborhood Zoning District; and
WHEREAS, a duly advertised Planning Commission public hearing was held on
November 6, 2008; and
WHEREAS, at their regular meeting of November 6, 2008 the Planning Commission
recommended conditional approval of this application to the Town Council; and
WHEREAS, the Town Council held a duly advertised public hearing on this application
on December 9, 2008; and
WHEREAS, the staff recommends conditional approval; and
WHEREAS, the Council has concluded that the approval of the application would be in
the public interest and in accordance with sound zoning and planning principles.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that
Special Exception application TLSE-2008-0010, Spring Arbor Assisted Living Residence at 237
Fairview Street, N.W., identified in the Loudoun County Land records as Parcel Identification
Number 270-30-3560, is hereby approved subject to the following conditions:
1. Conformance Standard. Development of this property shall be in substantial
conformance with the Rezoning Concept Plan/Special Exception Plat titled Spring Arbor
at Leesburg dated August 2008, revised through October 6, 2008, prepared by Loiderman
Soltesz Associates and proffers dated November 21,2008. The Rezoning Concept Plan
consists of 9 sheets including the cover sheet, existing site conditions, overall site plan, 3
pages of conceptual storm water management, an open space, vehicular, and pedestrian
plan, an existing vegetation map, and building elevations.

2. No Waivers Implied. Approval of this special exception does not express or imply any
waiver or modification of the requirements set forth in the Subdivision and Land
Development Regulations, the Zoning Ordinance, or the Design and Construction
Standards Manual (DCSM) except as specifically approved by Town Councilor as
shown as approved by Town Council on the Rezoning Conceptual Plan/Special
Exception Plat and supporting documents.
3. Utility Locations and Street Trees. Prior to or concurrent with the initial submission of
a site plan the applicant will work with Town staff to identify utility locations that will
maximize accommodation of street tree planting areas.
4. Mechanical Equipment Screening. Any mechanical equipment shall be screened from
neighboring properties by appropriate architectural elements, topography, and/or
landscape plantings.
5. Stormwater Management Pond Landscaping. Subject to applicable laws, regulations,
and policies the applicant shall provide landscaping within the dry stormwater
management pond above the two-year water surface elevation where such plantings do
not interfere with pond functions and operations.
6. Stormwater Management Pond Design. Subject to applicable laws, regulations, and
policies the applicant shall use decorative stone (such as river stone) in lieu of standard
riprap where stone is required in the design of the pond and/or the associated inlet and
outlet structures.
