A RESOLUTION: APPROVING SPECIAL EXCEPTION TLSE-2008-0011, MARGARET
PAXTON MEMORIAL LEARNING AND RESOURCE CAMPUS,
CHILD CARE CENTER FOR 140 CHILDREN AND GENERAL
EDUCATION SCHOOL FOR 75 STUDENTS LOCATED AT 420
WILDMAN STREET, NE.
WHEREAS, the Arc of Loudoun has requested special exception approval to permit a
Child Care Center for 140 children and a General Education School for 75 students located at
420 Wildman Street, NE; and
WHEREAS, the property is located in the R-l - Single-Family Residential Zoning
District; and
WHEREAS, the Planning Commission and Town Council held a joint Public Hearing on
December 18,2008; and
WHEREAS, the Planning Commission recommended conditional approval; and
WHEREAS, staff recommends conditional approval subject to the conditions contained
in the November 26,2008 Staff Report; and
WHEREAS, Town Council has determined the proposed uses meet the special exception
standards for a Child Care Center and General Education School as set forth in the Zoning
Ordinance; and
WHEREAS, Town Council has determined that the Approval Criteria of Zoning
Ordinance Section 3.4.12 have been satisfied; and
WHEREAS, Town Council has determined that the proposal would serve the public
necessity, convenience, general welfare and good zoning practice.

WILDMAN STREET, NE.
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia that the
Special Exception application TLSE-2008-00 11, Margaret Paxton Memorial Learning and
Resource Campus, is herby approved to permit a child care center for 140 children and a general
education school for 75 students located at 420 Wildman Street, NE., and as further identified in
the Loudoun County Land Records as Parcel Identification Numbers 187-25-3385 and 187-25-
7333, subject to the following conditions:
1. Substantial Conformance:
Development of this special exception use shall be in substantial conformance with the
Special Exception Plat entitled "Special Exception Plat for Margaret Paxton Memorial
Learning and Resource Campus" dated July 7, 2008, revised November 13, prepared by
William H. Gordon Associates, Inc. This plat includes Sheet 1 of 3 (Cover Sheet),
Sheet 2 of 3 (Overall Map and General Notes), Sheet 3 of 3 (Concept Plan).
2. No Expressed or Implied Waivers:
Approval of the special exception does not express or imply any waiver or modification
of the requirements set forth in the Subdivision and Land Development Regulations, the
Zoning Ordinance, or the Design and Construction Standards Manual (DCSM) except
as specifically approved by Town Council or as shown as approved by Town Council
on the Special Exception Plat and supporting documents.
3. Recreational Area Fencing:
A fence at least four (4) feet in height shall completely enclose the outdoor recreation
area of each child care center building in accordance with TLZO Sec. 9.3.4.B.
4. Play Equipment:
No play equipment shall be located within the required yard setbacks in accordance
with TLZO Sec. 9.3.4.C.
5. Catoctin Circle Access:
The connection to Catoctin Circle, including any necessary turn lanes and striping in
the public right-of-way, shall be installed prior to the issuance of the initial occupancy
permit for the child care center use on the property.

6. Public Facilities Permit:
Prior to the issuance of a zoning permit for any use on the property, any required public
facilities permit shall be obtained.
