(part of 4.45..2) attachments ITEM #2: Text amendment to Section 11.10 to require a full year waiting period from the time an amendment is acted upon until it can be resubmitted by a citizen. (attachment) ITEM #3: Text amendment to Section 6.6 to require parking standards at Schools: Elementary, Middle, and Kindergarten to be one space per staff member plus 15 visitor spaces. TOWN BOARD T)ESENT: MINUTES JOINT PUBLIC HEARING OCTOBER 24, 1989 Mayor Fred Cates, Remus Smith, Michael Kirby, Bobby Riley, Horace Johnson, Allen Lloyd PLANNING BD.William Crowther (Chair), Margaret Moore (alt.), Tarleton Davis, PRESENT: Cheshire Cole, Dr. Robert Murphy, Richard Simpson, Samuel Jones PLANNING BD.Ida Louise Evans, Kenneth Chavious, Wayne Tilley, Jim Culbreth (alt.) ABSENT: OTHERS Mr. Brown, Mr. Brown, Juanita Sturdivant, Cecil and Audrey Miller, PRESENT: Neal Littman, Julie White, Patty Riley, Agatha Johnson, Phillip Whitaker, Joff Coe, Janet Rigsbee Mayor -Cates opened the meeting and turned the meeting over to William Crowther who welcomed the public and noted the procedure of hearing the public hearing items. ITEM #1: The rezoning of a 74.83 acre tract for Centerpointe Development Inc. located on the east side of S. Churton St. from AR to GC was presented by Rigsbee. She showed the location on a display map and said that the surrounding zoning was 01 to the north, and residential to the north, south, east, and west. She read portions of the Neal Littman letter (agenda) and said that they will submit a request for rezoning the balance of the property upon its annexation and completion of the development plan. Some areas will need zoning other than GC. She read the intent and application criteria of GC zoning (agenda) and reviewed the screening notes, current uses and history of the property (agenda). She read the future require- ments (agenda). She summarized a letter of Danny Rogers, NCDOT Thoroughfare Planning, (which board members had a copy of) and said that the General Statutes do allow for requiring dedication of a thoroughfare in the zoning and subdivision ordinances. She said that Hillsborough ordinances allow for dedication of thoroughfare at the subdivision stage but the zoning ordinance does not mention dedication of thoroughfare so she thought that it would not be appropriate to require dedication at this time. Mayor Cates asked about the stream buffer along Cates Creek and Rigsbee replied that a 50 foot buffer as measured from the middle of the stream is required. Remus Smith asked about extending Oakdale Dr. through to Hwy 86 and Rigsbee said that it could be required at the subdivision stage. Margaret Moore asked if there willbarterial streets in the acreage and Rigsbee responded that the plans are not yet developed showing the street system. Cecil Miller asked how the parcel would have access onto S. Churton and Rigsbee responded that other streets would be shown at the subdivision stage. Neal Littman, speaking for Centerpointe, said that legally they cannot make application for zoning of a 174.9 acre parcel because only the area north of Cates Creek is now in the Town's zoning area. He said that the northern part of this parcel is served by Town Page 2 Public Hearing, 10/24/89 water and sewer. Littman said that there are plans to develop at first offices, distribution, and flex space where water useage is quite low. As soon as they complete development plans and acquire the remainder of the property, they will submit an annexation request, rezoning, and subdivision requests. This is just the first step. There was no public comment. ITEM #2: The Text Amendment to Section 11.10 to require a full year waiting period from the time a text or map amendment is acted upon until it can be resubmitted by a citizen was explained by Rigsbee. She read. the changes (agenda). Horace Johnson asked how an amendment could be reconsidered before thf year is up and Rigsbee said that the Board of Commissioners is allowed to initiate an amendment before the.year is up. She said thal a Town Board member would have to sponsor the amendment for a citizen and the Board agree if a citizen wanted a change before the year expired. Crowther said that this amendment was requested by the Planning Board and felt that Rigsbee's rewrite of Section 11.10 is good. There was rio public comment. ITEM #3: The Text Amendment to Section 6.6 to require parking standards at schools: elementary, middle, and kindergarten to be one space per staff member plus 15 visitor spaces was --presented by Rigsbee. She said that this was brought to the Planning Board' -s attention because of the addition at Central Elementary School and Dr. Dan Lunsford asked the Board to reconsider the parking standard.. She said that Dr. Lunsford had asked for the above standard and the Planning Board agreed. She said that after thinking about the requirement she thought that because enrollments in schools vary it may be good to base.the extra visitor spaces on enrollment. Therefore she suggests that the parking requirement could read: One space per staff member plus one visitor space for every 25 students. She said that she checked the ordinances from Orange County, Chapel Hill, and Carbboro and that this standard exceeds the above. Mayor Cates asked if this included secondary schools and Rigsbee said no, only elementary, middle and kindergarten. Smith asked if her recommendation would accomodate the needs at Central Elementary and she said yes that she had checked the enrollment there and based,the calculation upon that enrollment. Crowther said that this was brought forth as far as the Chair was concerned that the meets the wishes of the Board. There was no public comment.
