A RESOLUTION: AUTHORIZING CONCURRENT REVIEW BY THE BOARD OF
ARCHITECTURAL REVIEW FOR REZONING AND SPECIAL
EXCEPTION APPLICATIONS IN THE H-1 AND H-2 OVERLAY
DISTRICTS
WHEREAS, certain rezoning and special exception applications include property
that lies within the H-1 Old and Historic Overlay District and/or the H-2 Historic Corridor
Architectural Control Overlay District; and
WHEREAS, the Town Council desires to provide an efficient review process
whereby applications receive input from the Board of Architectural review (B.A.R.) early
in the design phase to minimize potential conflict with Town Council legislative actions;
and
WHEREAS, on February 27, 2008 the Town Council directed that rezonings and
special exception applications in the H-1 and H-2 Overlay Districts must receive legislative
approval from the Town Council prior to an application being filed for B.A.R. review; and
WHEREAS, on February 23, 2009 the Town Council directed staff to bring various
issues before the Planning Commission and the B.A.R. for comment and recommendation;
and
WHEREAS, on March 19, 2009 the Planning Commission and the B.A.R. held a
joint meeting and recommended to the Town Council that B.A.R. review should occur
concurrently with the processing of a rezoning or special exception application in the H-1
and lor H-2 Districts.

THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia
that in all cases where an application for a rezoning or special exception lies within the H-1
Old and Historic Overlay District or the H-2 Historic Corridor Architectural Control
District the applicant shall submit concept elevations of any proposed structure to the
planning staff as part of the second submission of a legislative application but before the
application is heard by the Planning Commission. These general elevations will provide
information regarding proposed size, scale, massing and location on the site and shall be
referred out to the B.A.R. for comment. The B.A.R. shall not make a binding or appealable
decision but will act in the capacity of a referral agency and will issue a comment memo
intended to inform the applicant, the Planning Commission and Town Council of issues that
could arise in the later B.A.R. application review. The BAR, when acting in the capacity of
a referral agency shall offer referral comments on a timely basis that in no way will delay
scheduled public hearings. Subsequent to Town Council action on the legislative
application an application for a certificate of appropriateness may be submitted to the
B.A.R. for review and action.
